Big weekend incoming, NSW.

This Sunday 4 October, clocks spring forward one hour as daylight saving begins, which means longer evenings, more golden hour, and yes, one slightly groggy Monday morning.
And that Monday? It's Labour Day 5 October, a NSW public holiday.
So: an extra hour of daylight AND a long weekend. We'll take it.

For employers, a quick reminder before you switch off:
✅ Public holiday pay obligations apply for Monday 5 October
✅ Check your award or enterprise agreement for penalty rates

Employees on long service leave over this period? The public holiday extends their leave by one day if they ordinarily would have worked it.
Now go enjoy the weekend. You've earned it.

Here's a date worth knowing: 9 May 1985.
That's the day the NSW Long Service Leave (Amendment) Act 1985 was assented to and with it, casual workers in NSW were formally confirmed as being entitled to Long Service Leave.
Before that amendment, entitlement was tied to an unbroken contract of employment. For casuals, that was a barrier that left long-serving workers without the recognition they deserved.

The 1985 amendment changed that. It established that service is measured across one or more contracts of employment, permanent, casual, part-time, or any other basis.

In plain terms: if you're a casual worker in NSW who has worked for the same employer under a pattern of engagements for 10 years, you have a LSL entitlement. You've had one for over 40 years.

And yet, it's still one of the most misunderstood rights in NSW workplaces.
That's exactly why we released the LSL Guide. That's exactly why we built the Digital Credentials Course. And that's exactly why we keep showing up in the rooms where these conversations happen.

Labour Day in NSW is observed on Monday 5 October, honouring the historic movement for an eight-hour working day. And it's just around the corner.

Before the long weekend arrives, a quick employer checklist:
✅ Check your award or enterprise agreement for public holiday pay obligations.
✅ Confirm rostering arrangements and notify staff
✅ Make sure your payroll system has the date flagged correctly
✅ Got employees on long service leave over this period? Public holidays don't count as LSL, the leave extends by one day if the staff member ordinarily works on that day.

That last point catches people out every time. It's covered in the NSW Industrial Relations Long Service Leave Guide and it matters.

Planning to retire? Here’s what you need to know about long service leave.

Here's how it works:
10 or more years of continuous service? You’re entitled.
Between 5 and 10 years continuous service and retiring? No Entitlement. Unless the worker terminates their employment on account of illness, incapacity, domestic necessity, pressing necessity OR the worker dies.
Less than 5 years of continuous service? Unfortunately, no entitlement, regardless of the reason for leaving.

One more thing worth knowing: if you have 15 or more years of service, the NSW Industrial Relations Long Service Leave Guide now clarifies that your entitlement is calculated to the exact day, not rounded down to completed years. For long-serving employees, this can make a meaningful difference.

Retirement is a milestone. Make sure you leave with everything you're entitled to.

Spring has officially arrived and with it, a good reminder to check what's coming up on the NSW public holidays calendar.
Knowing your public holiday obligations isn't just good planning. For employers, it directly affects rostering, payroll, and penalty rate obligations. For some workers, it affects entitlements you shouldn't have to chase.
What's still to come in 2026:
Labour Day - Monday 5 October
Christmas Day - Friday 25 December
Boxing Day - Saturday 26 December (plus substitute day Monday 28 December)
The NSW IR public holidays page has everything you need to know regarding NSW Public Holidays and Local Public Holidays.

The NSW Industrial Relations Long Service Leave Guide published 1 March 2026 was recently referenced in a judgment handed down by the NSW Industrial Relations Court:
United Workers Union v All Staff Australia Sydney Pty Ltd [2026] NSWIC 39.
Section 4.4.1 of the Guide “fortified” the Court in their view that no transmission of business had occurred.
The Guide is a clear and practical resource for employers, workers, and practitioners alike.
If you haven’t read it yet, now is a very good time.
