RE: ACQUITTAL AND DISCHARGE OF SEDINA TAMAKLOE ATTIONU
FALSE AND MISLEADING COMMENTS

I have become aware of a false and devious narrative being churned out by communicators of the National Democratic Congress (NDC) and other agents and hirelings of the Government, in a bid to shift the blame for the acquittal of Madam Sedina Tamakloe Attionu onto the Akufo-Addo Government and principally my good self as the immediate past Attorney-General and Minister for Justice.

The relevant record speaks for itself, and, will always vindicate:

1. No notice of an appeal filed by Sedina Attionu in 2024 came to the attention of the Office of Attorney-General in my tenure. State attorneys in both oral and written submissions indicated this fact to the Court of Appeal in April 2026 - that they had not been served with a notice of the appeal and that, they became aware of the proceedings only after the Court of Appeal directed the Parties to file their written submissions.

2. In any event, even if an appeal was filed by Sedina Attionu in 2024, it is completely immaterial because no further step was taken by her as the accused/appellant until the NDC came back to power. Thus, the Republic had to do nothing in 2024 in terms of the conduct of that appeal.

3. What I, as the Attorney-General who had superintended a successful prosecution had to do, was to ensure that the convicted person, Sedina Attionu, was brought to Ghana to serve the sentence lawfully passed by the High Court of Ghana. I thus took the important step to pursue an extradition request. The competence of my extradition request was upheld in the Order of the United States District Court of Nevada on 9th April, 2026, which confirmed the extradition and committed Ms. Attionu to custody pending her extradition by the Secretary of State.

4. Throughout the Sedina extradition proceedings, which commenced in July, 2024 and concluded in April, 2026, no mention was made of an appeal filed by Sedina Attionu in 2024 against her judgment (not even in the processes filed by Sedina herself in the US District Court).

5. Lawyers for Sedina Attionu only obtained leave from the Court of Appeal to file written submissions on 10th February 2026 and proceeded to file the said written submissions on 12th February, 2026. At this time, I was not in office as the Attorney-General.

6. My understanding is that the prosecuting state attorneys were surprised when they were served with the written submissions of the accused/appellant on 16th February, 2026 because they had no prior notice of the pendency of any proceedings. Nonetheless, they put together written submissions in opposition to the appeal and applied for leave from the Court of Appeal to file same, which they did on on 9th April, 2026.

7. In their written submissions, the Principal State Attorney repeated her complaints about an incomplete record of appeal, an omission from the record of all the exhibits tendered by the Prosecution at the trial and the fact that they “became aware of the instant proceeding ... after the Court had directed the Parties to file their written submissions”.

8. The Court of Appeal presided over by Her Ladyship Mensah Datsa JA, proceeded to enquire into the fundamental matters raised by the state attorneys which affected the Court’s jurisdiction to determine Ms. Attionu’s appeal, by ordering that 3 volumes of the Record of Appeal, which the Republic did not have access to at the time it filed its written submissions, be given to the Republic. This was done. The matter was adjourned.

9. After a perusal, the Republic applied for an inclusion into the record of appeal of three documents. This application was granted on 28th May, 2026 and the matter was adjourned to 17th June, 2026. In all of this, I was not the Attorney-General.

10. On 17th June, 2026, a different panel of the Court of Appeal presided over by Ankamah JA, sat on the matter for the first time and adjourned for judgment.

11. The public opprobrium and rejection of the acquittal and discharge of Sedina Tamakloe Attionu are merited considering the cogent evidence led at the trial, which enjoyed massive media coverage, and was thus easy for all to appreciate.

12. The development is consistent with the predilection of the Attorney-General to discontinue all cases which were being prosecuted against leading members and affiliates of the NDC. It smacks of an orchestration to clear the lady of her felonious acts and highlights the growing perception of Ghana’s current justice system - two sets of law for two sets of people. Equality before the law exists only in theory and is not lived practically. The Sedina Scandal is the closest Ghana has been to a re-enactment of the Woyome Scandal.

13. Ghanaians ought to demand more from a government which set out after inauguration, to discontinue all criminal cases pending against its leading members only to launch, immediately thereafter, a policy of ORAL by which it aggressively parades leading members of the opposition in court on alleged corruption related offences in trials conducted under extremely difficult conditions. The Attorney-General in these circumstances must be held to very high standards in the prosecution of cases.

14. A justice system in which political friends face no accountability and time-honoured rules are compromised for their comfort whilst political opponents are treated like second-class citizens and struggle for their basic rights and freedoms to be respected in criminal trials reflects poorly on the State.

God bless us all!!!

PRESS RELEASE!!!

RE: UNLAWFUL ARREST OF HANAN ABDUL-WAHAB AT THE AIRPORT, ACCRA DESPITE COURT ORDER

The attention of the firm of Messrs. Dame & Partners has been drawn to a Facebook post by the Deputy Attorney-General and Deputy Minister for Justice, Dr. Srem Sai, on 4th July, 2026 purporting to justify an unlawful arrest of Hanan Abdul-Wahab (our client) after having been granted permission to travel to the United Kingdom, by an order of the High Court, Accra dated 29th June, 2026.

The said Facebook post, laden with falsehood, was a lame attempt to cover up the Attorney-General’s deplorable authorisation for an order of a court of competent jurisdiction to be violated with impunity. We set out the true facts.

1. Following an application filed by his lawyers, our client, Hanan Abdul-Wahab, was permitted by the High Court presided over by His Lordship Justice Achibonga, Justice of the Court of Appeal (sitting as an additional High Court Judge), to travel for an appointment with his Optician from 4th July to 12th July, 2026. This was after the Judge had considered arguments from counsel in the matter including Dr Srem Sai.

2. The order of the court was consistent with precedent permitting accused persons on trial to travel in exercise of their fundamental human right to freedom of movement and right to medical care. The record shows that in the recent past, persons standing trial for similar offences as our client - Dr. Stephen Opuni, Seidu Agongo, Alhaji Collins Dauda, Dr. Cassiel Ato Forson, Dr Kwabena Duffuor and many others - were regularly permitted by the court to travel in and out of the country whilst standing trial.

3. The allegation by the Deputy Attorney-General that our client

attempted “to use false means to empty his frozen bank account with Republic Bank ...” is simply untrue. We challenge him to produce evidence of a withdrawal of any sum by our client from any of his bank account since the date of the court order.

4. In any event, there is no valid order of any court of competent jurisdiction freezing our client’s accounts. Our client’s accounts were frozen last year pursuant to investigations which resulted in his earlier arrest and prosecution. On 5th May, 2026, the charges against our client were withdrawn leading to his discharge. This resulted in a lapse of all orders made by the High Court, relating to bail and freezing orders, in respect of his earlier prosecution.

5. On 15th May, 2026, fresh charges were filed by the Republic against our client. On 20th May, 2026, the High Court, Adentan, presided over by His Lordship Justice Kwame Osei Gyamfi, held that “the re-arrest began a fresh process” and implied that “there is no valid freezing order” in place. We have explained the true position of the law in a formal letter delivered to the Executive Director of the Economic and Organised Crimes Office (EOCO) about 2 weeks ago.

6. It is thus grossly deceptive and misleading for the Attorney-General and his Deputy to deploy the Bureau of National Investigations (BNI) to arrest our client based on a false allegation of an attempt to withdraw money from a frozen bank account (evidence of which does not exist).

7. We consider the development very serious as it confirms our suspicion that the Attorney-General and his Deputy are the masterminds of the frequent violations of court orders by law enforcement agencies and the persistent harassment of our client and other citizens of Ghana under the current administration. We will accordingly institute proceedings for contempt of court against the Attorney-General, his Deputy and the Director of BNI for this blatant and wilful violation of an order of a court of competent jurisdiction. Freedom, in fact, has become a rare and expensive commodity!

RETRACT AND APOLOGISE OR I WILL SUE YOU – GODFRED DAME WARNS OFOSU KWAKYE

FORMER A-G, GODFRED DAME DEMANDS RETRACTION AND APOLOGY FROM OFOSU KWAKYE

Former Attorney-General and Minister for Justice, Godfred Yeboah Dame, has taken the current Minister for Government Communications, Felix Kwakye-Ofosu to task over what he deems untruthful and malicious publications made about the former Attorney-General.

Mr. Dame has, in a letter dated 12th March, 2026 delivered to Mr. Ofosu Kwakye and only now sighted by the media, demanded the Minister for Government Communications to take the following actions within seven (7) days of receipt of the letter:

1. A retraction and apology for the utterly false publication about me (Godfred Dame) on Metro TV’s “Good Morning Ghana programme on 10th October, 2025 the subject matter of this letter.
2. A permanent deletion of the publication complained of from all online portals.
3. Delivery of a formal written apology to me (Godfred Dame), acknowledging the harm caused.

Basis for the demand
In the demand notice, the former Attorney-General noted that on Friday, 10th October, 2025, Felix Kwakye Ofosu appeared as a panellist on the widely watched television programme on an Accra-based television station - Metro TV - dubbed “Good Morning Ghana”, and made allegations that Mr. Dame was complicit in illegal mining (galamsey) by allegedly refusing to take action on a docket on Akonta Mining presented to the former Attorney-General when he was in office.

“On the said programme, you categorically asserted without any basis that I, the undersigned, when serving the Republic in the capacity of Attorney-General and Minister for Justice from 2021 to 2025, had deliberately ignored a report confirming illegal mining activities allegedly perpetrated by Akonta Mining Company Limited, a company owned by the Ashanti Regional Chairman of the NPP, Bernard Antwi Bosiako (Wontumi). According to you, the report had been presented to me in office as Attorney-General of the Republic by the Criminal Investigations Department (CID) of the Ghana Police Service. Among other things, you stated:
President Akufo-Addo was not willing to punish anybody for anything that he did under his government. They engaged in illegal mining. The CID investigates, and then you come on national television and say that the person who has been fingered in that CID report is innocent, and did nothing … he knew It… If he didn’t know, then he did not deserve to be in the position. The Attorney-General of the day [my good self] cannot claim that he didn’t know about the report.” Parts of the letter written by Godfred Yeboah Dame stated.

Remarkably, a co-panellist on the programme with you, Mr. Paul Adom-Otchere, intervened almost immediately and drew the attention of the Minister for Government Communications to the falsity and seriousness of the wild allegations he had made about him live on a television programme watched throughout the nation and accessible globally via Facebook, YouTube and other modern instruments for transmission of information. Specifically, Mr. Adom-Otchere stated on the programme: “Maybe you should call the Attorney-General and ask him … that the Government Minister says you are aware of the report. He says I am not aware of the report”.

According to Godfred Dame, surprisingly, spurred on by a vicious desire to disseminate false and defamatory information about his good self, Felix Kwakye-Ofosu continued to say:
“Paul, what you are saying has grave implications for the competence of Godfred Dame as Attorney-General. What you are saying is that … I am saying that there was a CID report done in 2022 and given to the Government which they did not act on. I am saying that the Attorney-General and the Government are aware. The implication of what you are saying is that he (Dame) was not fit for the job and by inaction he was complicit in galamsey by inaction.”

RTI Request and falsity of Ofosu Kwakye’s allegations
The former Attorney-General and Minister for Justice who served the Republic from 2021 – 2025, asserts that Ofosu Kwakye’s false allegations were republished by various websites and media houses and sparked intense alarm and dismay in view of the seriousness of the subject matter and the deep implications for him, a citizen who held the respectable office of Attorney-General and Minister for Justice for four years. Consequently, one Jonathan Asare, a Ghanaian private legal practitioner, filed a right to information (RTI) request to the Office of the Attorney-General and Ministry of Justice to ascertain the veracity of the allegations.

However, in a response to the RTI request signed by the designated Information Officer of the Ministry of Justice and Office of the Attorney-General, a Lydia Attoh, delivered on 22nd December, 2025, the Office of the Attorney-General and Ministry of Justice categorically exposed the falsity of Ofosu Kwakye’s claims when it indicated that the CID did not present any docket on the alleged mining activities of Akonta Mining Limited to the Office or to Mr. Godfred Yeboah Dame between 2022 and 2024.

Further, the Office of the Attorney-General and Ministry of Justice stated clearly that the docket on Akonta Mining, in relation to which the current Minister for Government Communications made the allegations, was presented to the office only on 15th September, 2025. Mr. Dame attached a copy of the responses to the RTI request delivered by the Office of the Attorney-General and Ministry of Justice to the demand notice on Felix Ofosu Kwakye for ease of reference.

Defamation and implications for reputation
The former Attorney-General in his demand on the current Minister for Government Communications, noted that the allegations by Felix Kwakye Ofosu “were not only false but sinister, reckless and malicious given that as Minister for Government Communications, you have access to every means of verifying the truth of information you publish about the official record of former senior officials of government and all ministries in the Republic. Your statements about me, like many others you have published about me on different occasions in the past, were the product of a hateful and vicious imagination. The recklessness with which you published the words complained of betrays the deep-seated malice you bear against me. Indeed, the internet and mass media are replete with many false and malicious statements you in particular, and other associates of your political party, the National Democratic Congress (NDC) in general, have made about me. Mr. Dame stated.

To demonstrate the harm caused by Felix Kwakye Ofosu’s defamatory publication, the former Attorney-General and Minister for Justice touted his respectable record as a legal practitioner with about twenty-three years standing at the Bar, which “reflects active devotion to the promotion of human rights, constitutionalism and freedom of expression”. Mr. Dame noted that he acted as counsel “in some of the most significant trials in the courts of Ghana over twenty years ago (at a time that you [Felix Kwakye Ofosu] had not even entered the university”.

Mr. Dame further pointed out to Felix Kwakye Ofosu that in public service, he earned an even more respectable image on the international stage as on numerous occasions as he led projects and represented Ghana on various fora including, the United Nations, the African Union, Economic Community of West-African States (ECOWAS) and international tribunals. “My record in an effective and sound legal representation of the State internationally speaks for itself.” Mr. Dame stated.

The former Attorney-General observed further that the publication in falsely attributing to him complicity in the criminal enterprise of illegal mining (galamsey), directly depicted him as a criminal. Other allegations by Ofosu Kwakye about him were also clearly defamatory in a serious way, calculated to disparage him and “stray way beyond the permissible limits of free speech and brings me into public odium and contempt.”

He served a warning on the Minister for Government Communications that “should you fail to comply with this demand within 7 days of the delivery of this letter, I will surely institute legal proceedings against you and the owners of Metro TV (the network which provided you the platform) for punitive and aggravated damages for defamation as well as costs of litigation.”
