司法機構今日宣布將設立香港國際商事法庭，專門審理重大的跨境國際商事糾紛。對香港而言，這不但是增設一個專門法庭，而是進一步提升國際商事糾紛的處理機制，令其更國際化和更有效率。這項舉措標誌著香港法治發展邁向新里程，同時亦積極對接國家「十五五」規劃，深化香港作為「國際法律及解決爭議服務中心」的重要功能。

所謂更國際化，體現在參與法官、判案質素和判例影響力之間相輔相成的關係。該法庭將會聚焦處理複雜且高價值的國際性商業糾紛，而審理案件的法官不僅來自香港，亦會包括其他普通法司法管轄區中、在該類案件具備聲望和經驗的法官，有助判決更貼近國際商業社會對商事爭議解決的實際需求和合理期望。隨着相關判例逐步累積，香港普通法在國際商事領域的發展亦更容易獲得海外法律界和商業社會關注，進一步提升香港作為國際法律及爭議解決中心的制度吸引力。

效率方面，香港國際商事法庭亦可透過專門實務安排和程序規則，加快案件管理和審理流程。對國際商業社會而言，重大商事爭議往往牽涉龐大利益、複雜交易和時間成本。案件能否在合理時間內處理，均是選擇爭議解決地點時的重要考慮。這正是設立專門商事法庭的實際價值所在。

作為高等法院轄下的法庭，《高等法院條例》及《高等法院規則》已為設立香港國際商事法庭提供所需的法律框架。司法機構將發布專用的實務指示，以訂明香港國際商事法庭的司法管轄範圍內的案件類別以及詳細的法庭程序。

訴訟、仲裁和調解是解決爭議的三大主要途徑。香港在積極發展國際仲裁和調解的同時，訴訟依然是最基本及不可或缺的爭議解決方式之一。香港作為國際金融中心，司法制度穩健完善，設立香港國際商事法庭，能為跨境交易、國際貿易、金融、基建或投資項目等全球高價值或複雜的商事爭端，提供公平、公正和專業的處理機制，切合國家、香港和國際商貿社會的需求和期望，亦會為香港法律業界帶來新機遇。

司法機構的目標是在未來一年內設立香港國際商事法庭，高等法院大樓其中一層將指定供香港國際商事法庭使用。特區政府全力支持和配合香港國際商事法庭的籌備工作及相關安排。

🌟 2026年調解周圓滿結束 - 感謝支持

律政司主辦的「2026年調解周」主題活動已於5月4日至7日順利舉行。今年以「一分調解 十分和諧」為題，四天活動共吸引超過 1,500人次參與。

活動反應熱烈，充分展現調解日益成為社會不可或缺的一部分。無論是校園衝突、體育糾紛、長者議題，還是樓宇滲水問題，越來越多的人選擇以調解作為鼓勵溝通解決爭議的首選方式。活動期間，來自不同界別的朋友，包括調解員、學生、老師、運動員、長者、社工、物業管理人員及律師等，齊聚一堂，交流探討如何以調解代替對抗，促進溝通，修補關係，共建和諧社區。

🌟 Mediation Week 2026 Successfully Concludes - Thank You for Your Support

The Department of Justice’s Mediation Week 2026 Thematic Events were successfully held from 4 to 7 May. Under the theme “One Attempt of Mediation Harvests Abundant Harmony”, the four-day event attracted over 1,500 participants.

The enthusiastic response highlights how mediation is becoming an increasingly indispensable part of our society. From campus conflicts and sports disputes to elder matters and building water seepage issues, mediation is now a preferred approach for resolving differences. Throughout the event, participants from all walks of life, including mediators, students, teachers, athletes, seniors, social workers, property management professionals, and lawyers, came together to explore how mediation can replace confrontation, enhance communication, repair relationships, and help build a more harmonious community.

Our sincere thanks to all speakers and every participant who joined us, both online and in-person. Let us continue to bring the spirit of mediation into practice in our daily lives. Together, we take one more step and harvest abundant trust and harmony! 💛

The Department of Justice (“DoJ”) is once again organising the Mediation Week this year, under the theme “One Attempt of Mediation Harvests Abundant Harmony”.

Mediation can be applied to a wide variety of disputes. Whether involving disagreements at school, conflicts on the sports field, elder-related matters, or water seepage issues, mediation offers an effective way to reach resolution.

From 4 to 7 May, we will organise a series of thematic seminars to explore how mediation can replace confrontation, strengthen communication, repair relationships, and build a more harmonious community.
