π¨ WHY ARE POLICE HARASSING BARS THAT ARE LEGAL? π¨
A CONSTITUTIONAL CRY FROM BAR OWNERS & HUSTLERS π°πͺπ»
Let me speak with fire in my heart and the Constitution of Kenya, 2010 in my hands.
Because this question is burning the streets, the estates, the trading centres:
π£οΈ βWHY DO POLICE KEEP DISTURBING BARS THAT HAVE ALL LICENCES?β
π THE PAINFUL TRUTH
Many bar owners:
βοΈ Have a valid liquor licence
βοΈ Pay county fees
βοΈ Sell legal alcohol
βοΈ Follow opening hours
Yet stillβ¦
π Police storm in
π Demand money
π Threaten closure
π Harass customers
π THIS IS NOT LAW ENFORCEMENT THIS IS ABUSE OF POWER.
π WHAT DOES THE CONSTITUTION SAY?
π₯ ARTICLE 40 Right to Property
You have the right to own property and run a lawful business.
π Your bar is your livelihood.
π Your stock is your sweat.
π ARTICLE 47 Fair Administrative Action
Every person has the right to:
βοΈ Lawful
βοΈ Reasonable
βοΈ Procedural action
π¨ Harassment, intimidation, and extortion are UNLAWFUL.
π ARTICLE 41 Right to Fair Labour Practices
Running a bar is WORK.
Stopping it unlawfully is economic violence.
π ARTICLE 244 Role of the Police
Police must:
βοΈ Serve the people
βοΈ Respect human rights
βοΈ Act professionally and lawfully
β NOT to extort
β NOT to intimidate
β NOT to terrorize businesses
π₯ SO WHY DOES THIS HAPPEN?
Let us be honest:
π£ Corruption
π£ Abuse of discretion
π£ Ignorance of the law (on both sides)
π£ Weak reporting by victims
Fear keeps the system alive.
βοΈ HOW DO WE STOP THIS LEGALLY?
β 1. HAVE YOUR DOCUMENTS READY
* Liquor licence
* County permit
* Health & fire compliance
πΈ Take photos. Keep copies.
β 2. ASK ONE SIMPLE QUESTION (CALMLY):
π£οΈ βOfficer, under which law are you closing or disturbing my business?β
π¨ Many illegal actions die right there.
β 3. DO NOT PAY BRIBES
Bribes feed harassment.
Silence empowers abuse.
β 4. REPORT
βοΈ IPOA (Independent Policing Oversight Authority)
βοΈ DCI
βοΈ County Alcohol Control Board
βοΈ Court (Judicial Review / Constitutional Petition)
π ARTICLE 22
Every Kenyan has the right to go to court when rights are violated.
β 5. UNITY IS POWER
When bar owners speak together, harassment reduces.
Divide and rule is their weapon.
π₯FINAL MESSAGE TO KENYANS:
π£οΈ A licensed bar is NOT illegal
π£οΈ Selling legal alcohol is NOT a crime
π£οΈ Police power is NOT unlimited
π Harassment is not law. Extortion is not law. Fear is not law.
π₯ THE CONSTITUTION IS THE LAW.
π’ Share this message. Educate each other. Defend your hustle.
Because when we know our rights, abuse becomes expensive.π°πͺβ
