THE MWANANCHI PARTY STATEMENT ON THE COLLAPSE OF THE MULTI-STOREY BUILDING IN EASTLEIGH

NAIROBI, 23RD OCTOBER 2026, The Mwananchi Party regrets the tragic collapse of the multi-storey building in Eastleigh, Nairobi County. We offer our heartfelt condolences to all who have been injured and lost their lives in the avoidable, catastrophic structural breakdown.

The Mwananchi Party affirms that this accident could have been avoided if we had an intentional and focused County Government. Growth of a city should not be left to the ambitions of builders but should be the joint responsibility of qualified city planners, architects and city engineers. We categorically state the buck stops with the Governor of Nairobi- Johnstone Arthur Sakaja, we have lost 9 lives because of incompetence, heartlessness and ruthless corruption by his administration

The unfortunate and tragic collapse of the multi-storey structure in the city is a harrowing reminder of the systemic failures, lack of regulatory oversight, and deeply entrenched negligence that currently plagues our city's administration. Our thoughts and deepest sympathies go out to the victims, their families, and all affected residents in Nairobi County.

This disaster is not an isolated incident; it is the direct result of a county leadership that consistently prioritizes political posturing over public safety, basic infrastructure, and strict urban planning controls. For far too long, the people of Nairobi have suffered under an administration that turns a blind eye to uninspected developments and failing safety standards. We call on the people of Nairobi to find comfort in the reality that this administration’s days are numbered.

Nairobi deserves a leadership that guarantees accountability, enforces strict building codes, and prioritizes the safety and dignity of every citizen. It is time to rebuild trust in our city's governance and deliver an administration that works for the people, not against them.

In alignment with The Mwananchi Party ideology pillar on social justice, we commit to establish a Nairobi County Administration that prioritizes the safety of Mwananchi, one that will safeguard the investments of Mwananchi and guarantee the well being of the investors in the building of the city and the users of the installation within, we shall not entertain the promotion of construction without order. Under The Mwananchi Party, Nairobi shall regain its lost glory, this is our pledge to Wananchi today.
Once more we send comfort to all who have been affected by the accident and stand in solidarity with them in these difficult times.
Signed,

Casper Sitemba

FOR IMMEDIATE RELEASE

PRESS STATEMENT: THE MWANANCHI PARTY REJECTS MOVE TO SCRAP MANDATORY LIVE-STREAMING OF ELECTION RESULTS

Nairobi, 23 October 2026: The Mwananchi Party, its members and leadership strongly oppose the National Assembly’s passage, on 22 October 2026, of the Elections (Amendment) (No. 2) Bill, 2024 (Senate Bill No. 29 of 2024). We welcome many of the proposed reforms, but we cannot accept provisions that would roll back hard-won gains in electoral management. As patriotic wananchi, we will defend the integrity of our elections against any such retrogression.

Clause 22 repeals and replaces Section 39 of the Elections Act, 2011, and in doing so removes the duty, previously set out in Section 39(1G), requiring the Independent Electoral and Boundaries Commission (IEBC) to live-stream results as they are announced at polling stations. That duty was designed to protect the integrity of results transmission. Although the amended text retains the electronic transmission of result images, uploads to the online portal and the physical delivery of Form 34A, dropping the live-streaming obligation severely weakens public oversight at the most critical moment of the count.

Kenya should tread carefully when amending its electoral rules. A country whose citizens have lost considerable trust in their government cannot responsibly remove the very provisions that allow them to scrutinise the process. Kenyans are politically aware and their democracy has matured; it is unreasonable to expect them to wait passively for results. The Mwananchi Party will defend their right to track results as they are relayed, in accordance with Article 35 of the Constitution and our ideological pillars of Constitutional Freedom and Social Justice.

Grounds for Rejection

1. A setback to post-2007 reforms and public trust. Mandatory technology and live result broadcasts were central recommendations after the 2007 post-election crisis, intended to restore confidence in our democratic process. Public trust has since continued to wane, so transparency and scrutiny must be strengthened rather than withdrawn. Removing this guarantee is a retrogressive step that would revive suspicion in closely contested polls.

2. Loss of real-time public verification. Live-streaming gives citizens, party agents and observers immediate visual confirmation of tallies as presiding officers read them out, assuring everyone that votes are being relayed without interference. It is a vital safeguard against alteration of figures before they reach tallying centres, a claim raised in previous elections. Without a legal mandate, such claims would return, and suspicion with them.

3. Protection against information blackouts and disinformation. On tense election nights, delays or suspensions in result broadcasts create information vacuums, which the proliferation of citizen-led news channels makes especially fertile ground for propaganda. Past cycles show that such blackouts heighten anxiety and fuel fake news. Uninterrupted live streaming provides a steady, verified flow of information straight from polling stations.

4. Weakened media and civil society oversight. In the 2022 General Election, live result feeds enabled the media and independent observers, such as the Elections Observation Group (ELOG), to run Parallel Vote Tabulations and round-the-clock concurrent tallies. Scrapping the mandate undermines these watchdogs’ ability to verify official outcomes independently and in real time, and so diminishes the legitimacy of the process.

5. Violation of constitutional principles (Articles 35 and 86). Article 86 requires that electoral technology and results transmission be simple, accurate, verifiable, secure, accountable and transparent. Article 35(3) obliges the State to publish and publicise important information affecting the nation, and Article 35(1) guarantees access to information needed to protect a right or fundamental freedom, here the political rights enshrined in Article 38. Static portal postings without live broadcasts fall short of this standard of openness.

Call to Action

As the Bill returns to the Senate for concurrence on the National Assembly’s amendments:
• We call upon the Senate and the National Assembly Mediation Committee to reinstate the statutory duty under Section 39 compelling the IEBC to live-stream results as declared at all polling stations.

• We urge the Executive to uphold constitutional fidelity under Articles 35 and 86 by rejecting any framework that weakens real-time electoral transparency ahead of the 2027 General Election.

• We urge Kenyans to remain vigilant and refuse any erosion of their right to free, fair, credible, transparent, accountable and secure elections.
