Audierea procurorului Ion Covalciuc, evaluat în legătură cu candidatura sa pentru funcția de judecător al Curții Supreme de Justiție (CSJ), s-a concentrat în principal pe aspecte ce țin de integritatea financiară.

Membrii Comisiei au adresat întrebări privind economiile gospodăriei, inclusiv mijloacele financiare deținute în conturi bancare și în numerar, precum și aspecte legate de cheltuielile de consum ale populației (CCP), indicator statistic utilizat în evaluările financiare.

Totodată, candidatul a oferit explicații privind eventuale discrepanțe financiare pentru perioada 2014–2016 și a răspuns la întrebări referitoare la posibila nedeclarare a unui împrumut către Autoritatea Națională de Integritate, în condițiile prevăzute de lege.

The candidate also provided explanations regarding potential financial discrepancies identified for the period 2014–2016 and responded to questions concerning the possible failure to declare a loan to the National Integrity Authority, as required by law.

Comisia de Evaluare a Judecătorilor publică rapoartele aferente procedurilor de evaluare și reevaluare în cazul judecătorului Petru Triboi, președinte interimar al Judecătoriei Ungheni.

În evaluarea inițială a judecătorului, Comisia a emis o concluzie de nepromovare. În urma reevaluării și examinării unor circumstanțe noi, care nu au putut fi analizate în etapa inițială, Comisia a constatat că judecătorul întrunește criteriile de integritate financiară și etică și a propus ca acesta să promoveze evaluarea externă✅.

The Judicial Vetting Commission is publishing the reports related to the evaluation and re-evaluation procedures concerning Judge Petru Triboi, Acting President of the Ungheni Court.

In its initial evaluation, the Commission issued a non-promotion decision. Following the re-evaluation and the examination of new circumstances that could not be assessed during the initial stage, the Commission concluded that the judge meets the financial and ethical integrity criteria and proposed that he pass the external evaluation ✅.

The Superior Council of Magistracy reviewed and approved the Commission’s re-evaluation report.

Completele de evaluare B și C au audiat astăzi repetat judecătorii Vitalie Budeci și Veronica Cupcea, în cadrul procedurilor de reevaluare dispuse de Consiliul Superior al Magistraturii (CSM).

🔹 Judecătorul Vitalie Budeci, de la Judecătoria Chișinău, este evaluat în contextul candidaturii sale pentru funcția de judecător la Curtea de Apel Centru. Reevaluarea a vizat exclusiv aspectele indicate de CSM în hotărârea prin care a fost respins raportul inițial de evaluare.

Membrii Completului B au adresat întrebări privind:
▪️ posibile discrepanțe între venituri și avere pentru anii 2013–2015 și 2017–2019;
▪️ eventuale cheltuieli de călătorie nedeclarate;
▪️ cheltuieli de consum ale gospodăriei și economii în numerar;
▪️ un aspect de integritate etică legat de implicarea într-o cauză soldată cu constatarea unei încălcări a CEDO.

Subiectul evaluării a prezentat explicații suplimentare, inclusiv privind donațiile invocate anterior. În ședință închisă au fost audiați și doi membri ai familiei sale.

🔹 Judecătoarea Veronica Cupcea, președinte interimar al Judecătoriei Orhei, a oferit explicații membrilor Completului C privind circumstanțele contractării unui împrumut în 2011 și presupusa substituire ulterioară a rambursării acestuia.

Totodată, au fost examinate fluxurile financiare ale gospodăriei, cu accent pe eventuale aspecte de avere inexplicabilă pentru perioadele 2013–2014, 2017 și 2020. În cadrul audierii, judecătoarea a fost asistată de avocatul său.

Evaluation Panels B and C held repeated hearings today for judges Vitalie Budeci and Veronica Cupcea as part of the re-evaluation procedures ordered by the Superior Council of Magistracy (SCM).

🔹 Judge Vitalie Budeci of the Chișinău Court is undergoing evaluation in connection with his candidacy for the position of judge at the Central Court of Appeal. The re-evaluation focused exclusively on the issues identified by the SCM in its decision rejecting the initial evaluation report.

Members of Evaluation Panel B asked questions regarding:
▪️ possible discrepancies between income and assets for the periods 2013–2015 and 2017–2019;
▪️ potential undeclared travel expenses;
▪️ household consumption expenses and cash savings;
▪️ an ethical integrity issue related to the judge’s involvement in a case that resulted in a finding of a violation of the European Convention on Human Rights (ECHR).

The evaluated subject provided additional explanations, including regarding donations previously invoked. During the closed session, two members of his family were also heard.

🔹 Judge Veronica Cupcea, Acting President of the Orhei Court, provided explanations to Evaluation Panel C regarding the circumstances surrounding a loan obtained in 2011 and the alleged subsequent substitution of its repayment.

The panel also examined the household’s financial flows, focusing on potential issues of unexplained wealth for the periods 2013–2014, 2017, and 2020. During the hearing, the judge was assisted by her lawyer.

Avocatul Ion Bîtcă a fost audiat astăzi de Comisia de evaluare a judecătorilor, în cadrul procedurii de evaluare a integrității pentru funcția de judecător al Curții Supreme de Justiție.

Audierea s-a desfășurat cu participarea tuturor celor nouă membri ai Comisiei și a vizat, în principal, aspecte legate de integritatea financiară. Au fost discutate donații primite de la membri ai familiei, veniturile declarate de soția candidatului ca fiind obținute în străinătate, precum și anumite potențiale discrepanțe patrimoniale identificate pentru anii 2014–2016, 2018, 2020, 2022 și 2024.

Totodată, Comisia a solicitat clarificări privind circumstanțele în care au fost dobândite anumite bunuri, pe care candidatul le-a calificat drept donații.

Lawyer Ion Bîtcă was heard today by the Judicial Vetting Commission as part of the integrity assessment procedure for the position of judge at the Supreme Court of Justice.

The hearing was conducted with the participation of all nine members of the Commission and focused primarily on issues related to financial integrity. Discussions covered donations received from family members, income declared by the candidate’s spouse as earned abroad, as well as certain potential asset discrepancies identified for the years 2014–2016, 2018, 2020, 2022, and 2024.

The Commission also sought clarifications regarding the circumstances under which certain assets were acquired, which the candidate described as donations.

At the candidate’s request, part of the hearing was held in closed session. A family member of the candidate was also heard in closed session.

ℹ️ In addition, the hearing of Judge Ion Bulhac, scheduled for today as part of a re-evaluation procedure, was postponed to a later date due to technical reasons.

Comisia de Evaluare a Judecătorilor a finalizat evaluarea tuturor judecătorilor care au deținut sau dețin funcția de președinte sau vicepreședinte de judecătorie, inclusiv în exercitarea interimatului acestor funcții, în ultimii cinci ani.

Astăzi, Comisia a transmis către Consiliul Superior al Magistraturii ultimele două rapoarte de evaluare, vizând judecătorii Angela Catană, fost vicepreședinte interimar al Judecătoriei Chișinău, sediul Buiucani, și Corneliu Guzun, fost vicepreședinte al Judecătoriei Chișinău, sediul Rîșcani.

În ambele cazuri, Comisia a constatat neîntrunirea criteriilor de integritate și a propus nepromovarea evaluării externe de către cei doi magistrați❌.

La această etapă, rapoartele nu produc efecte juridice, urmând ca Consiliul Superior al Magistraturii să decidă asupra acceptării sau respingerii acestora.

The Judicial Vetting Commission has completed the assessment of all judges who have held or currently hold the position of court president or vice-president, including those who served in an acting capacity, over the past five years.

Today, the Commission submitted to the Superior Council of Magistracy the final two evaluation reports concerning judges Angela Catană, former acting vice-president of the Chișinău Court, Buiucani sOffice, and Corneliu Guzun, former vice-president of the Chișinău Court, Rîșcani Office.

In both cases, the Commission found that the integrity criteria were not met and proposed that the two judges do not pass the external evaluation❌.

At this stage, the reports do not produce legal effects, as the Superior Council of Magistracy is to decide whether to accept or reject them.

Consiliul Superior al Magistraturii (CSM) a examinat în cadrul ședinței de astăzi raportul Comisiei privind reevaluarea judecătoarei Natalia Mămăligă – candidată la funcția de judecător al Curtii de Apel Centru.

CSM a acceptat propunerea Comisiei ca judecătoarea Natalia Mămăligă să promoveze evaluarea✅. În cadrul reevaluării dispuse de CSM, Comisia a menținut concluzia formulată în evaluarea inițială, nefiind identificate circumstanțe noi care să determine modificarea constatării anterioare.

📑Rapoartele de evaluare inițială și reevaluare vor fi publicate după expirarea termenului legal de contestare.

The Superior Council of Magistracy (SCM) examined during today’s meeting the Commission’s report on the re-evaluation of Judge Natalia Mămăligă, a candidate for the position of judge at the Court of Appeal Centre.

The SCM accepted the Commission’s proposal that Judge Natalia Mămăligă pass the evaluation✅. In the re-evaluation procedure ordered by the SCM, the Commission maintained the conclusion reached in the initial evaluation, as no new circumstances were identified that would lead to a change of the previous findings.

📑The reports on the initial evaluation and re-evaluation of Judge Natalia Mămăligă will be published after the expiry of the legal appeal period.

Consiliul Superior al Magistraturii (CSM) a examinat astăzi raportul Comisiei privind reevaluarea judecătorului Petru Triboi - subiect al evaluării externe în calitate de președinte interimar de instanță.

Cu 12 voturi „pro” și 0 „împotrivă”, CSM a acceptat propunerea Comisiei ca judecătorul Petru Triboi, președinte interimar al Judecătoriei Ungheni, să promoveze evaluarea✅.

📄Amintim că, în cadrul evaluării inițiale, Comisia formulase o concluzie de nepromovare. Ulterior, în procedura de reevaluare, au fost examinate circumstanțe faptice noi, prezentate de către CSM, care nu au putut fi analizate în etapa inițială. În urma analizei suplimentare, Comisia a constatat că magistratul întrunește criteriile de integritate financiară și etică prevăzute de lege și a propus promovarea evaluării.

⭕️Raportul va fi publicat după expirarea termenului legal de contestare.

The Superior Council of Magistracy (SCM) examined today the report of the Commission regarding the re-evaluation of Judge Petru Triboi, a subject of external evaluation in connection with his exercise of the position of interim president of the court.

With 12 votes “in favor” and 0 “against,” the SCM approved the Commission’s proposal that Judge Petru Triboi, interim President of the Ungheni District Court, should pass the evaluation✅.

📄During the initial evaluation, the Commission issued a non-passing conclusion. Subsequently, in the course of the reevaluation procedure, the Commission examined new factual circumstances submitted by the SCM, which had not been available for consideration at the initial stage. Following the additional analysis, the Commission found that the magistrate meets the legal requirements of financial and ethical integrity and proposed that he pass the evaluation.

⭕️The report will be published after the expiration of the statutory appeal period.

✔️ poate solicita clarificări candidatului, dacă este necesar

Procesul se desfășoară conform Legii nr. 26/2022 și vizează verificarea integrității financiare și etice.

The process is carried out in accordance with Law No. 26/2022 and focuses on assessing financial and ethical integrity.
