On the issue of non-compliance with the Electoral Act & INEC Regulations & Guidelines, Justice Tsammani says the only technological device that is mandatory for INEC to use for the election is the Bimodal Voters Accreditation System (BVAS).
He adds that there is nothing in the regulation to show that the BVAS must electronically transmit polling unit results.
The tribunal also held that IREV is not a collation system, and the judgement in the case of Oyetola vs. INEC clearly supports this.
“There is no provision for the electronic transmission of election results in the Electoral Act 2022," says Justice Tsammani. It is, at best, optional.

PRESIDENT TINUBU PROMISES TO ADDRESS CONCERNS OF CRITICAL STAKEHOLDERS AS HE ASSURES OF COMPREHENSIVE CRIMINAL JUSTICE REFORM
President Bola Tinubu on Thursday promised that his administration would conclude a thorough review of the remuneration templates of judicial officers in the country.
Receiving the leadership of the Nigerian Bar Association (NBA), led by Barrister Yakubu Maikyau (SAN), the President said the battle against corruption necessitates a comprehensive review of the salaries and allowances of judicial officers, an issue that is well known to him, given his landmark success in reforming justice administration in Lagos State.
"We must deal with the review of remuneration if we truly want to fight corruption in the Judiciary. We will look at the cost as well as the consequences," he said in response to a request by the NBA president.
President Tinubu equally acknowledged the importance of addressing the current vacancies within the Supreme Court, affirming that these vacancies represent obligations that must be fulfilled based on recommendations put forth by the National Judicial Council (NJC).
"Majority of them are on holiday now and when they return, we will take a look at what they have and we will fill the vacancies. It’s a fulfillment of an obligation," he said.
The President thanked the NBA for extending an invitation to him to declare open the association’s 63rd Annual General Conference this weekend in Abuja.
He acknowledged his privilege of having numerous lawyers as close aides, including the Chief of Staff, Rt. Hon Femi Gbajabiamila, the State Chief of Protocol, Amb. Victor Adeleke, and his Principal Private Secretary, Prince Damilotun Aderemi.
The NBA President, in his remarks, commended the President for appointing very distinguished members of the bar into his cabinet, including Lateef Fagbemi, the Attorney-General of the Federation and Minister of Justice.

“I keep receiving toxic calls and messages regarding my meeting with the president yesterday, and from those I hold in very high esteem. Honestly, I am shocked at the contents of the messages and tone of the callers. Has Nigeria sank this low?
A visit I made for the good of our dear nation is what they are using to threaten my life and family! You don’t recognise someone as your president yet begging him to save you from the hands of killers in your region.
I am bringing investors to Nigeria using the president’s commendable policies as a bait. Is that too difficult to understand? President Tinubu’s reforms might be harsh now but they would birth a new and prosperous nation.
I have lost count of presidents, respected Institutions and investors that have called to congratulate me on Nigeria eventually having a focused leader since the reforms were rolled out. At least, six multi national manufacturing giants are coming with me by December later this year to see how their firms can have factories here. It’s all part of my contributions to the progress of Nigeria.
I am not a politician. I only desire the best for my dear country. It informed my visit to president Tinubu. The world has accepted him as our president, like it or not. May God heal us”
