Please be advised Vapes are now illegal to import into Nauru . Nauru Customs will be enforcing this law.

The To***co control Amendment Act 2024 became active 20th August.

Vapes are defined as imitation To***co Product which includes E cigarette.

e-cigarette’ means a device whether or not containing ni****ne or to***co that generates or releases or is designed or intended to generate or release, by electronic means, an aerosol or vapour for inhalation by its user in a way that resembles, or produces an experience similar to, smoking and includes v**e or a device which resembles a toy, food, drink, cartoon character, animal, musical instrument, vehicle or household or any other object

Section 12A Prohibition on imitation to***co products
(1) A person shall not manufacture, possess, distribute or sell imitation to***co products in the Republic.

(2) A person shall not import or export imitation to***co products into or outside of the Republic.
(3) For the purposes of any law regulating the importation of goods, a imitation to***co product is a prohibited import.
(4) A person who contravenes subsection (1) and (2) commits an offence and upon conviction is liable to:
(a) in the case of an individual:
(i) forfeiture of any to***co imitation products; and
(ii) a fine not exceeding $2,000 or a term of imprisonment not exceeding 12 months or both; or
(b) in the case of a body corporate, forfeiture of any imitation to***co products and a fine not exceeding $20,000.

Can brokers please ensure they are using the correct statistical values, ie KG , LTRS , UNIT with the right amounts. This information is critical in measuring trade in the nation. This means you will need to calculate the actual amount based on the paperwork you have from the importer, we can see some brokers are simply making it up, so please ensure you are correct in your entries, or we will take firm action. Brokers please ensure you are using the correct tariff rates for soft drinks and fruit juice. The Brix (sugar) content is the key to the correct rate to use. Customs has worked with the Department of Health to assess the soft drinks and other sugar drinks from a health perspective to keep Nauru healthy against Diabetes.

Customs can advise brokers if they are unsure as to the correct rate for the type of drink.

The rates changed in July last year in the Tariff schedule so please make yourself aware of these changes.

* Voyage: MCP V037N (i.e. MCP space V037N)

Please be guided that NSL requires the Master BOL(MBL) only i.e. Bill Of Lading(BOL) for the whole container (FCL), and not portions of cargo contents in the container.

As the consignee/notify party stated on the MBL, please obtain a copy of this BOL from your shipper/supplier to then present it to NSL (office or email) in exchange for NSL Release form. Please forward the Arrival Notice email to your Broker along with a copy of the BOL.

For consolidated loose cargoes, please obtain a copy of the House BOL(HBL) from your shipper/supplier and present it to the MBL consignee/notify party. NSL does not devann/dispatch loose cargoes. We can however, assist you to track the FCL MBL holder you should liaise with for your cargo.

Please be advised that the Customs threshold for All Goods
(except liquor and to***co) arriving goods imported by parcel post or airfreight; that are for a private individual, has been lifted from $200 to $600 by Cabinet decision. Customs took note of community concerns and sought to lift the threshold.

You will not need a broker or an Asycuda declaration for goods that are now valued $600 or under.

The process is that Customs will clear cargo at the Post office for community safety issues, once cleared the goods are free to be released to you without the need for Customs to be involved further.

Please note that Customs can also verify the value of the goods if required and may, at their discretion, determine that more than one parcel consigned to the same or several consignees, may be treated as a single parcel and in such cases, duty shall be assessed accordingly.

This threshold is for personal goods for an individual, if they are sold on " Buy and Sell" or anywhere else, they become commercial and they lose the exemption in the Tariff Code 109 Part 2, Chapter 98.

If they are being sold, Customs will require duty is paid and can seize the goods as they are "uncustomed".

We have been told that importers do not want to give brokers invoices or receipts and this holds up the assessment of the declaration as Customs MUST have that. The Customs act requires this information to calculate the duty.

From the Act " invoice’ for any imported goods, means the original invoices, bills of lading, bill of parcels, policies of insurance, letters and other documents showing the value of the goods at the place at which they were purchased, together with the freight, insurance and other charges on the goods.

Section 64. Production of invoice and declaration
(1) On the first entry (other than an entry for removal of any goods,) the importer or the importer’s agent must:
(a) produce to the Chief Collector or other Customs officer the invoice for the goods;

Registered importers may pay their duty by direct bank transfer but will need to show customs the receipt and what entry it is for.

For post to post, you do not need a broker (unless over $200) or register as business for postal packets. However if you bring in goods to sell on Facebook and Customs sees it is high volume, high value, high frequency, then you are acting like a business and will be required to register as one. This is for post to post only, in other words civic center post office. To***co, v**e, kava and alcohol are exceptions and will need a declaration if exceeding allowance in tariff act. We hope this clears up any confusion.
