UPDATE: ICC CONFIRMATION OF CHARGES HEARING VS. FORMER PRESIDENT RODRIGO DUTERTE (Day 1)

Today, February 23, 2026, the International Criminal Court in The Hague formally opened the confirmation of charges hearing against former President Rodrigo Duterte.

Let me clarify at the outset: this is not yet a trial.

What happened today was the start of a four-day hearing where ICC judges will determine whether there is enough evidence for the case to proceed to a full trial.

Former President Duterte did not personally attend the hearing. His lawyers asked that he be excused from appearing, and the court allowed it.

The prosecution presented its opening arguments and summarized the evidence they intend to rely on. They claim that the anti-drug campaign involved widespread killings that qualify as crimes against humanity under international law.

On the other hand, the defense is challenging the prosecution’s evidence and the manner in which certain information was disclosed. As expected, the former President continues to deny any wrongdoing.

No decision was made today on guilt or innocence.

The judges are only asking one question at this stage: "Is there sufficient evidence to move forward to trial?"

After the hearing concludes, the judges are expected to issue a written ruling within about 60 days.

EXPLAINER FOR EVERYONE

Many are confused about what this stage means. Let me simplify it.

This is similar to a preliminary determination. The court is not yet deciding whether the accused is guilty. The court is only deciding whether the evidence is strong enough to justify a full trial.

The standard used by the ICC at this stage is called “substantial grounds to believe.” That is lower than proof beyond reasonable doubt, which is required for conviction.

If the charges are confirmed, the case proceeds to trial.
If they are not confirmed, the case may be dismissed or returned for further evidence.

At this point, the presumption of innocence still applies.

This is a significant legal development, but it is only one step in a long process.
