RA 7877 Anti Sexual Harassment Act

🛑ANTI-SE_XUAL HARASSMENT ACT (RA 7877)

RA 7877 was enacted to protect employees, students, and trainees from se_xual hara_ssment committed by persons who have authority, influence, or moral ascendancy over them.

Se*xual harassment occurs when a person in authority (someone with moral ascendancy) demands, requests, or requires sexual favors from another person.

This commonly happens in:

✔ Workplace
✔ Educational institutions
✔ Training environments

The law focuses on situations where the offender abuses their power or influence over the victim.

WHO CAN COMMIT SE*XUAL HARASSMENT?

Under the law, the offender is usually someone who has authority or influence or moral ascendancy, such as:

• Employer
• Manager or supervisor
• Teacher or professor
• Trainer or instructor
• Person with moral ascendancy over another

WHEN IS SE*XUAL HARASSMENT COMMITTED?

Se*xual harassment exists when sexual favor is made a condition for employment, education, or opportunities, such as: (1) in the workplace, if sexual favor is made a condition for: Hiring; Promotion; Salary increase; Continued employment; (2) when refusal results in: Unfair treatment; Intimidation; or Hostile working environment; or (3) In Education or Training, If sexual favor affects: Grades; Scholarship;Honors; or Training opportunities.

LIABILITY OF EMPLOYERS AND SCHOOL AUTHORITIES

Employers and school administrators also have legal responsibilities.

They must:

✔ Prevent se*xual harassment
✔ Create rules and procedures for complaints
✔ Establish a Committee on Decorum and Investigation (CODI)

Failure to take action may also result in administrative liability.

PENALTIES UNDER RA 7877

Any person found guilty of se*xual harassment may face: Imprisonment; fine; and Administrative sanctions.

Ang Republic Act No. 9262 o ang Anti-Violence Against Women and Their Children Act of 2004 ay isang batas sa Pilipinas na nagbibigay proteksyon sa mga kababaihan at kanilang mga anak laban sa iba't ibang uri ng karahasan tulad ng pisikal, sekswal, sikolohikal, at ekonomikong pang-aabuso.

Layunin ng batas na ito na maprotektahan ang dignidad, kaligtasan, at karapatan ng bawat babae at bata laban sa anumang uri ng pang-aabuso mula sa asawa, dating asawa, kinakasama, dating kinakasama, nobyo, dating nobyo, o sinumang may relasyon sa kanila.

Sa pamamagitan ng IEC material na ito, nais naming ipaalam sa ating komunidad ang:
✔ Mga uri ng karahasan laban sa kababaihan at kanilang mga anak
✔ Mga karapatan at proteksyon na ibinibigay ng batas
✔ Mga paraan kung paano humingi ng tulong at proteksyon

Tandaan: Ang karahasan laban sa kababaihan at mga bata ay isang krimen. Sama-sama nating itaguyod ang isang ligtas, maayos, at mapayapang komunidad para sa lahat.

Reminder ulit po tungkol sa Prevention of Adolescent Pregnancy Bill:

Walang anumang probisyon sa Bill tungkol sa pagtuturo o paghikayat ng ma********on sa mga batang edad 0 to 4 years old o yung magtuturo daw diumano ng “bodily pleasure” sa mga batang 6-9 years old o na ituturo din daw sa bata na may “sexual rights” sila.

Absolutely NONE of these concepts exist in our Bill.
