TANONG: May parusa ba sa hindi pagdalo sa pagdinig na ipinatawag ng Lupong Tagapamayapa o Pangkat ng Tagapagkasundo? May kapangyarihan ba ang Barangay na magpataw nito?

TUGON: Oo, may parusa sa hindi pagdalo sa pagdinig na ipinatawag ng Lupong Tagapamayapa o Pangkat ng Tagapagkasundo, pero hindi direkta itong ipinapataw ng barangay.

Sa ilalim ng Section 515 ng Local Government Code (Republic Act No. 7160), kung ang isang partido o saksi ay sadyang tumanggi o hindi dumalo sa kabila ng tamang paanyaya, ito ay magreresulta sa mga sumusunod:

1. Indirect Contempt of Court

Maaaring magsampa ng aplikasyon ang:
(a) Lupon Chairman;
(b) Pangkat Chairman; o
(c) Sinumang partido
sa Municipal o City Trial Court upang ang hindi dumalo ay maparusahan bilang indirect contempt of court.

Ang ibig sabihin:
Ang hukuman ang magpapataw ng parusa, hindi ang barangay.

2. Epekto sa Reklamo o Depensa

Bukod dito, may mahalagang epekto sa proseso (procedural consequence) ang hindi pagdalo sa patawag, tulad ng:
(a) Kung ang complainant (nagrereklamo) ang hindi dumalo → maaaring ma-dismiss ang kanyang reklamo; at
(b) Kung ang respondent (inirereklamo) naman ang hindi dumalo → maaaring mawalan siya ng karapatang magsampa ng counterclaim (kontra-reklamo) o fi kaya ay maapektuhan ang kanyang depensa.

3. Layunin ng Parusa

Ang layunin ng prosesong ito ay hindi lamang magparusa kundi:
(a) tiyakin ang pagdalo at kooperasyon ng lahat ng partido; at
(b) mapanatili ang bisa ng sistema ng Katarungang Pambarangay bilang mekanismo ng amicable settlement o pag-aayos ng hidwaan.

Ang Abandonment of a Minor ay nangyayari kapag ang isang taong pinagkatiwalaan sa pangangalaga ng bata (tulad ng magulang, guardian, o tagapag-alaga) ay pinabayaan, iniwan, o hindi binigyan ng sapat na atensyon at pangangalaga ang menor de edad.

Kasama rin dito ang indifference of parents, o ang pagiging pabaya at walang malasakit ng magulang sa kanilang anak—tulad ng hindi pagbibigay ng sapat na pagkain, edukasyon, o proteksyon.

⚖️ ANO ANG PARUSA?
Ang sinumang mapatunayang nagkasala ay maaaring maparusahan ng:

- Prisión correccional (pagkakakulong)
- O iba pang kaukulang parusa depende sa sitwasyon at epekto sa bata

📍 SAAN DAPAT MAGSUMBONG?
Kung may nalalaman o nakikitang ganitong sitwasyon, maaaring magsumbong sa:

- 👮‍♂️ PNP (Philippine National Police)
- 🏢 DSWD (Department of Social Welfare and Development)
- 🏘️ Barangay Office sa inyong lugar

Nagkamali ng isang digit sa numerong pinadalhan ng pera ang assistant ni Hayden Sison at kaagad itong ipinaalam sa e-money issuer, ngunit sinabihan lang umano siya ng customer service na wala itong magagawa sa insidente. Bukod dito, na-block pa si Sison ng aksidente nakatanggap ng pera niya.

Dahil dito, nag-email ang biktima sa BSP, at nang sumunod na araw ay agad na nag-email ang e-money issuer at ibinalik ang pera sa kanya.

Sa ilalim ng batas, ang mga e-money issuers ay supervised ng BSP at may obligasyong umaksyon sa mga ganitong dispute.

Ayon naman sa legal experts na si Atty. Alman-Najar Namla, sa ilalim ng Article 2154 ng Civil Code, ang sinumang makatanggap ng bagay o pera nang dahil sa pagkakamali ay obligadong ibalik ito.

Ang pagtangging ibalik ang perang nagkamali ng padala ay maaaring ituring na unjust enrichment o estafa sa ilalim ng Revised Penal Code.

Ano ang gagawin kung mangyari rin ito sa inyo?

🤔 WHY SOME NON-DOH HOSPITALS ALSO GIVE ZERO BILL CARE

While the ZBB policy is officially for DOH-run hospitals, other public or accredited hospitals may also provide zero bill care through:

📌 PhilHealth’s No Balance Billing (NBB) Policy
PhilHealth’s longstanding No Balance Billing applies to indigent, sponsored, and certain groups in all PhilHealth-accredited hospitals — including some provincial, city, and private hospitals that choose to implement it.

📌 Malasakit Centers
Many hospitals — including non-DOH provincial/city hospitals — have Malasakit Centers where multiple government agencies pool subsidies (PhilHealth, DOH, PCSO, DSWD, Pagcor) to help pay bills so patients walk out with little or no balance.

📌 LGU-Local Assistance Programs
Some local governments fund their hospitals’ indigent care programs that eliminate bills for qualifying residents — separate from the DOH ZBB rollout. (This varies by LGU.)

So even if a hospital is not DOH-run or listed under ZBB, it might still help patients avoid bills through these other programs.
