“Bias is one of the most important tools in a criminal defence lawyer’s toolkit—not only for testing the truthfulness, credibility and reliability of prosecution witnesses, but also for identifying and exposing bias, prejudice or conflict of interest wherever it may arise in the criminal justice process, including in the conduct of prosecutors and, where legally permissible, in the impartiality of judicial decision-making. To deprive an accused on trial of the legal means to examine and challenge such bias is to rip the soul out of the criminal justice system. A trial in which the defence is denied the tools necessary to test the evidence, expose prejudice and challenge partiality cannot be a genuinely fair trial.”
