The Atlanta Economic Justice Program works in partnership with Housing Justice League (HJL) to protect tenant rights in Atlanta and surrounding cities. This spring, the HJL completed new editions of the Dekalb and Fulton County editions of its Eviction Defense Manual, which contains important information for tenants about eviction and instructs readers on steps they can take to defend their housing when served with notices.

Eviction Defense Manual CoverThese valuable documents walk tenants through the legal aspects of eviction, breaking down complicated legal terms and explaining requirements of landlords under the law and opportunities for tenant defense within the different stages of the process. PDF versions of the manuals can be viewed here.

According to the Census Bureau, nearly one in five renters, disproportionately Black and Latino renters as compared to white renters, are behind on their rent. Experts estimate that these households already owe up to $57 billion in back rent. Evictions put lives at risk and strain our already overstretched public health systems. As the CDC makes clear in its order, “eviction moratoria — like quarantine, isolation, and social distancing — can be an effective public health measure utilized to prevent the spread of communicable disease.” The CDC order rightfully holds that, “evictions threaten to increase the spread of COVID-19 as they force people to move, often into close quarters in new shared housing settings with friends or family, or congregate settings such as homeless shelters.” The CDC warned that these challenges “may be exacerbated as fall and winter approach” and found that “immediate action is necessary.” As outlined by the CDC, evictions have enormous consequences for individuals, their communities, and our nation’s public health. In fact, evictions occurring between the beginning of the pandemic and the issuance of the CDC moratorium in September 2020 led to more than 400,000 more COVID-19 cases and nearly 11,000 additional deaths.

While renters are still protected under the moratorium, this ruling and its potential effects are deeply concerning. The Biden administration must defend the CDC order in the courts and strengthen, enforce, and further extend the eviction moratorium for the duration of the pandemic. Sign your organization onto NLIHC’s letter urging the Biden administration to take action and ensure that tens of millions of renters do not lose their homes.

"In 2020, tenants who lost their jobs in the pandemic did something that homeowners caught up in the subprime mortgage crisis mostly did not do: they fought back. Although calls for “rent strike 2020” originated among weird online grifters, the last ten months really did see an uptick in collective action by renters. Actual organized rent strikes broke out in a number of cities, as tenants who had lost their jobs refused the pay and demanded that their landlords forgive the rent... No one really demanded an eviction moratorium... The eviction moratorium represents a useful lesson about how reforms actually happen. Normally, reforms represent the desperate efforts of elites to defuse escalating social crises, especially politically and economically disruptive protests."
