Williams v. DeKalb County (18CV8645) Civil Court Case headed back to DeKalb Superior Court for a 3rd time. Williams a citizen and taxpayer sued DeKalb County governing authority members for an unconstitutional salary increase in 2018.
The outcome of this lawsuit will have an impact on all 159 counties in GA. Williams has demonstrated taxpayer standing to pursue his claim of injunctive relief against Thurmond; we therefore reverse the trial court’s order finding that Williams did not have taxpayer standing and remanded this case to the trial court to properly consider in the first instance Williams’ claim for injunctive relief against Thurmond, including the issue of whether OCGA § 36-5-24 is constitutional. See Williams, v. DeKalb, County, 308 Ga 265 (2020), Williams v. DeKalb County 364 Ga. App 710 (2022)
It has taken 5 years in order for the court to conclude that Williams had standing to sue the DeKalb County CEO Michael Thurmond to enjoin the illegal salary payments and to recoup the over 1 million dollars paid since January 2019 back from the members of the governing authority members.
