Notary Tip: As a mobile notary public, you have to deal with varying personalities, some more cooperative than others. Brace yourself for incidences where people get upset, or even violent. This usually stems from them taking issue with the documentation. The best option for a traveling notary in such a situation is to stay calm so as not to agitate the individual further, and then subtly excuse yourself.

Notary Tip: Notarizations cannot be performed until all the persons who need to append their signatures on the document are physically present. If a person isn’t present, the Notary Public will decline to notarize his or her signature. Online notarizations, or notarizations via live video chat, are allowed in only a few of states.

A Notary Public can only advise on legal issues if he or she is a qualified attorney. Therefore, the Notary is not allowed to select the kind of notarization required. Additionally, the Notary cannot fill in the document, except for the wording on the notarial certificate. Finally, a Notary cannot advise on the legal implications of a document.

Notary Tip: The notarization of a marriage license isn’t the same as when you notarize a signature on a document. When you complete a marriage license, you are stating that you performed the marriage ceremony. So, the answer to your question is yes, if you performed the marriage ceremony, the date you notarize the marriage license is the date the marriage is official.

Notary Tip: The verbal notarial act is the most important part of the notarization. Without this verbal ceremony, the notarization essentially does not mean anything, and courts have dismissed documents when the notary failed to perform the notarial act.

Notary Tip: The notary public and signer must be able to communicate with each other without any language barriers. If there are communication barriers, a notary should not proceed with the notarization of the document. In some states, a signer may not use an interpreter to communicate with the notary when the notarial act is performed. Encourage the signer to have his or her document notarized by a notary public who speaks the same language. A notary public cannot act as an interpreter and a notary at the same time.

For an acknowledgment— “Do you acknowledge that this is your genuine signature and that you have executed this document voluntarily?”

For an oath or affirmation— “Do you solemnly swear (or affirm) that the contents of this document are true and correct?”
