Don and I were honored to be part of the 4th annual IP and Innovation Law Conference last Friday at Cleveland State University College of Law. Interesting new Federal Circuit opinion about standing to sue of a patentee who defaulted on its loan agreement:
TWEET1: IT v Zebra 5/1 holds patentee IT’s loan default gave its secured creditor the *option* to license patent but didn’t auto-divest IT of *all* exclusionary rights. IT still has Art III standing (injury in fact) to sue Zebra for patent infringement. WDTex (Albright) reversed.
TWEET2: NB: does *not* decide the distinct issue whether in default IT is still a 35 USC 281 “patentee” with “statutory standing.” If not, IT could cure this non-jurisdictional defect by joinder (unlike a lack of Constitutional standing).
