As of May 14, 2018 I am the owner of the property located at 3820 N. Keystone Ave. Since that time, I have been bitterly embroiled in a legal battle with Palmer Properties (“PP”), who sold me the property, and White Castle (“WC”), who leases from PP the property neighboring my own to the south. Unbeknownst to me at the time of purchase, the lease between PP and WC included several restrictions on the use of the property sold to me, namely (1) a prohibition against building anything within 200 feet of the shared boundary; and (2) an easement through my property for the entrance and exit of customers to the WC restaurant from Hillside Ave.
Notwithstanding severe intimidation and strong-arm tactics on the part of PP and WC, and a legal battle (Case #: 49C01-1910-PL-040979), the 200 feet restriction has been resolved to my satisfaction. The easement, however, remains an issue. While I recognize that the legal action WC/PP pursued against me (Case #: 49D13-2004-PL-013682) represented by 2 of the largest law firms in the state (Ice Miller LLP and Bose McKinney & Evans LLP) did not conclude in my favor, I continue to fervently believe that justice, equality and fairness will ultimately lead to my unrestricted use of my own land, or compensation for its continued use by WC/PP. The circumstances are even more egregious when one considers that WC is compensating PP in the form of monthly rent for the use of my land/the easement. Though I alone am responsible for paying the Marion county property taxes, including the easement, and commercial insurance, including the easement, I see no portion of this rent which is approximately $40,000/yr. This amounts to a private taking from me and unjust enrichment for the Palmer family. Furthermore, as it currently stands, PP and WC are free to include the easement in indefinite lease extensions (again with no portion of the compensation being paid to me), thereby preventing me from ever benefitting from my own land, either economically or through my own desired use.
It must also be stated that from all appearances, this easement is of no business use or actual value to WC. In the over 6 years that I have owned the property, I have witnessed WC's complete neglect and disregard for the easement with poor lighting, overgrown brush and trash. I also note that these conditions foster unrestricted use of this strip of land after dark for what appears to be illegal transactions. In addition, since the creation of the IndyGo purple bus line, the general public is using my land to avoid traffic, traffic lights and other roadway restrictions which adds to this unsafe and potentially hazardous stretch of road. My many inquiries to WC through legal counsel and PP as to what it would take to transfer the easement to me have been met with complete silence. With no economic activity tied to the easement, it is clear that WC’s sole interest is in denying me any benefit of my land while potentially exposing me to liability completely outside of my control.
To be clear, with the way they have handled this situation (to include suing me for their use and enjoyment of my land), WC and PP seem intent on making it clear to me that they have the money and will spare no expense legal or otherwise to oppress me. PP is literally being paid for WC's use of property that PP does not and has not owned for over 6 years while I, the owner of the land, am forbidden from using this property all the while receiving absolutely no compensation. It's hard to see this as other than me being bound by a forced economic subservience which directly impacts me but over which I have no control or influence. As such, community, anything you can do to bring more attention to this situation such that WC and the Palmer family are encouraged to reconsider their positions would be much appreciated.
My primary objective is to reach an equitable solution that secures for me release of the easement and free use of the space as soon as possible.
Community members from all walks of life, please join me in my quest for the right and freedom to use my land by taking the following:
(1) Provide the widest dissemination of this information on your social media platforms so that we can boycott all White Castle and Palmer Property businesses to allow them to experience economic consequences of their oppressive behavior.

(4) Visit White Castle restaurants and request a large cup of ice water or the most inexpensive item available and sit in the restaurant for as long and as often as possible. If you must make a purchase do so in all unwrapped pennies. Please use pennies for drive thru orders as well.
(5) Be kind, respect the employees and do not damage property.
(6) With your permission we will place or give you a White Castle and Palmer Properties" sign to be placed in your yard if you are within a certain radius of 3820 N. Keystone.
