What is a Notary Public?
- A Notary Public is an official of integrity appointed by the Secretary of State to serve the public as an impartial witness to help deter fraud.
- The

Notary verifies the identity of the signer with acceptable identification and witness the signing of important documents like but not limited too; Affidavits, Jurats, Acknowledgments, Loan documents, etc....
- A Notary will verify the signer willingness to sign the documents at hand as well as their awareness of the contents of the documents or transactions.
- The Notary can also administer Oath of Affirmation to the signer if one is required by the document at hand. What is a Mobile Notary?
- A Mobile Notary is any commissioned notary who upon request travels from location to location to perform notarial acts. The mobile notary will travel to you at your convenience time, prefer location and gets the notarial act done in a timely matter.
- A Mobile Notary can also charge a traveling fee for all services provided as well as provide services on demand or by appointment and in some cases, walk-ins are not available due to their services being fully and completely mobile. What is a Notary Signing Agent?
- A Loan Signing Agent is a professional whom is a state commissioned Notary Public specially trained to handle and notarize loan documents.
- The Signing Agent is the critical final step to perform and complete the closing ceremony for real estate/mortgage transactions.

- A Loan Signing Agent is contracted by a Title/Mortgage or Signing Service company to perform the closing ceremony for the borrower. In most cases the services provided by the signing agent are completely mobile and not necessarily in an office setting.
- The Signing Agent should always ensure to remain neutral to all parties in the transaction. They should also ensure awareness of documents contents by affiant as well as making a reasonable effort to prevent fraud and protect affiants from coercion. A Loan Signing Agent must remain impartial to the transaction and adhere to the notary laws of their state or jurisdiction. They are also prohibited from giving legal advice or interpret the meaning of any terms on documents at hand during the closing ceremony. Be aware, a Notary Public is NOT the same as the translation in Spanish "Notario Publico". The actual translation is correct, but the meaning is NOT the same in Latin America. In the US, only an attorney can give legal advice, provide legal help, or represent you in a court of law. Notaries are only allowed to verify the identity of a signer on important documents at hand. There are big differences between a "Notario Publico" from Latin American countries and a Notario Publico in the United States. The differences are:
- A "Notario Publico" from Mexico for instance is an individual who has received the equivalent of a law degree or license and is authorized to represent others in a court of law.
- A Notario Publico in Texas only certifies as well as witnesses identity and signatures of the signer on important documents at hand.
- A Notario Publico in the state of Texas does NOT practice law and cannot represent you in a court of law.
- The Notario Publico in the state of Texas cannot give legal advice, prepare legal documents, or give advice on immigration documents.

Acknowledgement -- The purpose of an acknowledgement is for a signer, whose identity has been verified by a Notary Public that he/she has willingly signed the document for the intended purpose. The notary must positively identify the signer according to the state rules.

An Acknowledgement requires the following steps:
1. The signer must appear in person before the Notary Public.
2. The notary must positively identify the signer according to your state's rules. A updated form of ID is needed to record signer's information on notary journal.
3. The signer signs the document before the Notary Public.
4. The signer declares (acknowledge) signing the document for its intended purpose. The signer must directly communicate with the notary that he/she willingly signed the document at hand.

Jurat....A jurat is a statement made by a person before a Notary Public attesting to the fact that they have sworn or affirmed to the truth of certain information contained in a document.
A jurat may also be referred to as a "notorial certificate" or "notarial act". It is one of several different types of statements that a Notary Public can make with respect to a document, & it is generally used for documents that will be submitted as evidence in legal proceedings.
You may need a jurat when executing certain legal documents, such as Power of Attorney, Deeds or Contracts. In these cases the jurat serves as proof that you understand the contents of the document & are willing to sign it under penalty of perjury.
