On Wednesday, September 30th, Sen. Jeff Merkley (D) attempted to pass S. 5670 by unanimous consent, a bill to restore Article I appropriations authority back to Congress as the president but the bill was blocked via objection by Sen. Ron Johnson (R). Several Senators argued the bill as a result of the president and OMB Director Vought's freeze on an additional $810 Million in funding to federal programs without congressional approval. Senators were especially aggrieved due to the President's late night cancellation of the funding on the eve of the end of the 2026 Fiscal Year undermining Congress' 45 day due process for the approval process. Please note eligibility is not based on household but on individuals so some households will receive multiple payments. The announcement below is a guide to eligibility for the rebate.

The charts attached give a closer look at the $500 ACA refund slated for the 950,000 qualified recipients across 30 states. In tracing CMS data on the states identified in the White House press release, the illustrations below provides an estimate of the number of eligible marketplace consumers and the total federal cost per each state. The following information are estimates based on independent research and are not provided by the White House. Also note that the payments are for health insurance consumers whose monthly premiums were NOT subsidized by the ACA Premium Tax Credits (APTC) which provided automatic price reductions on monthly insurance payments. It is also being reported that the payments have already began rolling out as of 10/1/26.

Trump announces a $500 refund to nearly a million Americans available only in 30 US. states just shortly before the Midterm Election, separate from the typical Medical Loss Ratio Rebate paid by insurance companies under the ACA plan when they fail to spend the required percentage of premium revenue on medical care and quality improvement. This new $500 payment comes through the federal government and concerns HealthCare.gov marketplace user-fee funds.
