പുതിയ നിയമപ്രകാരം ജോലിയില്‍ നിന്ന് രാജിവെച്ചോ പിരിച്ചുവിടപ്പെട്ടോ തൊഴില്‍ നഷ്ടമായ തൊഴിലാളിക്ക് വിലക്ക് ഏര്‍പ്പെടുത്തുന്നതില്‍ തീരുമാനമെടുക്കുക സര്‍ക്കാര്‍ അതോറിറ്റിയായിരിക്കും. നിലവില്‍ അതാത് തൊഴില്‍ സ്ഥാപനങ്ങളാണ് തീരുമാനം കൈകൊള്ളുന്നത്.

തൊഴിലുടമ കരാര്‍ പാലിക്കാതിരിക്കുകയോ, മതിയായ തൊഴില്‍ സാഹചര്യം ഒരുക്കാതിരിക്കുകയോ ചെയ്താല്‍ ജീവനക്കാരന് ജോലി ഉപേക്ഷിക്കാവുന്നതാണ്. നിബന്ധനകള്‍ പാലിക്കാതെ ജീവനക്കാരന്‍ ജോലിയില്‍ നിന്ന് വിട്ടുനിന്നാല്‍ തൊഴിലുടമയ്ക്ക് കരാര്‍ അവസാനിപ്പിക്കാനും പുതിയ നിയമത്തില്‍ വകുപ്പുണ്ട്.

പുതിയ നിയമത്തിലെ 765മ് വകുപ്പ് പ്രകാരം ജീവനക്കാരനോ തൊഴിലുടമയ്‌ക്കോ താല്‍പര്യമില്ലെങ്കില്‍ സേവനം അവസാനിപ്പിക്കാവുന്നതാണ്. ഇരുവര്‍ക്കും സമ്മതമാണെങ്കില്‍ എപ്പോള്‍ വേണമെങ്കിലും കരാര്‍ അവസാനിപ്പിക്കാം. ഒരു കക്ഷിയുടെ മാത്രം താല്പര്യപ്രകാരമാണ് സേവനം അവസാനിപ്പിക്കുന്നതെങ്കില്‍ മുന്‍ കൂര്‍ അറിയിപ്പ് നല്‍കണം.

തൊഴില്‍ കരാറുകള്‍ ഏകീകരിക്കുന്നതിനും നിശ്ചിത വ്യവസ്ഥകള്‍ ഉറപ്പുവരുത്തുന്നതിനുമാണ് 764മ് വകുപ്പ്. ജീവനക്കാരന്റെയും തൊഴിലുടമയുടെയും കടമകളും ഉത്തരവാദിത്വങ്ങളും അവകാശങ്ങളും കരാറില്‍ ഉള്‍പ്പെടുത്തിയിരിക്കണം.

വിദേശ തൊഴിലാളിയാണെങ്കില്‍ യുഎഇയില്‍ എത്തുന്നതിനു മുമ്പ് തന്നെ കരാറില്‍ ഒപ്പുവച്ചിരിക്കണം. ദിവസം എട്ട് മണിക്കൂറിലധികം ജോലി ചെയ്യില്ല അല്ലെങ്കില്‍ ആഴ്ചയില്‍ 48 മണിക്കൂര്‍,അതുമല്ലെങ്കില്‍ മൂന്നാഴ്ച 144 മണിക്കൂര്‍ എന്ന കരാറില്‍ ഒപ്പുവയ്ക്കണം.

റമദാന്‍ മാസത്തില്‍ പ്രതിദിനം രണ്ട് മണിക്കൂര്‍ കുറച്ച് ജോലി ചെയ്താല്‍ മതി. ഓവര്‍ ടൈം ജോലിക്ക് 25 ശതമാനത്തില്‍ കുറയാത്ത ഇന്‍ക്രിമെന്റ് നല്‍കണം. രാത്രി 9 നും വെളുപ്പിന് 4 നും ഇടയിലാണ് ഓവര്‍ ടൈം ജോലിയെങ്കില്‍ 50 ശതമാനത്തില്‍ കുറയാത്ത ഇന്‍ക്രിമെന്റ് നല്‍കണം. തൊഴിലാളികളുടെ തൊഴില്‍ സാഹചര്യം മെച്ചപ്പെടുത്തേണ്ടതും തൊഴിലുടമയുടെ ഉത്തരവാദിത്തമാണ്
