Judgment Just In:
The Court of Appeal has dismissed an appeal by Mr Scrivener against a decision finding that he was an accessory to breaches of fiduciary obligations owed to Mr Cappello and Shaka Holdings Pty Ltd by causing Tuscany Corporation Pty Ltd to fail to account to Shaka Holdings for one half of the profits derived from the acquisition and subsequent sale of three contiguous properties in Rouse Hill. Mr Scrivener was ordered to pay Mr Cappello $6,203,689.48 in equitable compensation, that amount representing half of the profits obtained by Tuscany on sale of the properties.

Judgment Just In:
The Court of Appeal has dismissed an appeal challenging the validity of three Public Health Orders, made by the Minister for Health and Medical Research under s 7(2) of the Public Health Act 2010 (NSW). The three impugned Public Health Orders had the effect of conditioning certain persons’ freedom of movement to travel to their workplaces upon them having received at least one dose of an approved COVID-19 vaccine or having been issued with a medical contraindication certificate. The Court held that the Public Health Orders were validly made and that they did not infringe the principle of legality or impair various asserted fundamental rights.
