DEMERIT POINTS

Be advised that if you choose to plead guilty or are found guilty at trial, the Justice of the Peace hearing the case has NO LEGAL AUTHORITY to waive, lower, dismiss or vacate any applicable demerit points to your driver’s licence. Demerit points are assigned to driver’s licences by the Ministry of Transportation.

Court Fines, Costs and Victim Surcharge:

If you are convicted and fine is imposed, the Justice of the Peace may or may not tell that there are court costs and a victim surcharge that will be added to your fine amount. The victim fine surcharge cannot be waived, lowered or dismissed by the Justice of the Peace or the Prosecutor.

DO NOT WAIT FOR THE NOTICE IN THE MAIL

If you were given 30 days to pay your fine then your fine must paid within 30 days of the day of conviction (the day you were in Court). Failure to pay (or obtain the appropriate extension) within the required time-frame will result in your Driver's License being suspended, referral of your fine to a debt collection agency for collection, and additional costs associated with collection and enforcement being added to your fine.

If your Driver's Licence is suspended you will need to pay the fine in full including all costs (court costs, administration costs, collection agency costs) as well as a reinstatement fee that is payable to the Ministry of Transportation.

Ignorance or no knowledge of law cannot be attributed to any deficiency on the part of the Court or the police officer.

DEMERITS POINTS FOR SPEEDING

Up to 15 km over - No Points

16 to 29 km over - 3 Points

30 to 49 km over - 4 points

Over 49 km - Vehicle impondment applies and Racing/Stunt driving and Mandatory license Suspension will apply.
