The Pagan Federation has noted the laying before Parliament, on 21 May 2026, of the Equality and Human Rights Commission's updated Code of Practice for Services, Public Functions and Associations. Our team is continuing to review the full document, but we wish to share our initial response with our community.
We welcome the Code's explicit recognition of Humanism, Atheism, and Ethical Veganism as examples of philosophical beliefs protected under the Religion or Belief characteristic of the Equality Act 2010. This is a positive and overdue clarification that strengthens protections for a broad range of sincere, deeply held beliefs — including Paganism in all its forms — and we believe it will benefit the wider community of minority faiths and philosophies in Britain.
However, critical portions regarding s*x and gender reassignment status are deeply disappointing, as we’ve previously said, following the April 2025 Supreme Court ruling on which this Code is substantially based: trans women are women, trans men are men, and all non-binary genders are valid. That position has not changed, and it will not change.
We are disheartened that the EHRC and Ministers have chosen to codify an approach that directs trans, non-binary, and inters*x people away from spaces that align with their lived identity and into third or separate spaces. Whatever the legal reasoning, the lived experience of being directed away — of being marked as other — is one of exclusion and harm. As a faith-based, inclusive organisation rooted in respect for the divine in all forms we honour the lived truths of all people. That does not bend to legal drafting or lawfare.
We also hold that biological reality is more complex than a simple binary, as inters*x variation across humanity and the natural world makes abundantly clear. Legislation that treats s*x as a fixed, uncomplicated binary does not reflect the fullness of our world.
We note that the Code remains subject to a 40-day parliamentary scrutiny period and has not yet come into force. The Pagan Federation will continue to monitor developments and to advocate where we are able.
To our trans, non-binary, and inters*x members and friends: Nothing about how we welcome you, include you, and celebrate you will change — because it doesn't need to. We see you, we honour you, you are loved, and we will continue to fight for your rights, dignity, and your place in our communities.
