Conclusion of High Court Judge
143. For the reasons set out above, I am satisfied that the grant of a final injunction against
the named defendants and Persons Unknown represents a proportionate and justified
response to the breaches of planning control identified in these proceedings. Whilst I
have given substantial weight to the personal circumstances of the occupiers, those
considerations are outweighed by the factors favouring enforcement.
144. Accordingly, I grant the claimant's application for a final injunction pursuant to section
187B of the Town and Country Planning Act 1990 in the terms set out in the
accompanying order, subject to the periods of suspension identified above.
Award of Costs
145. The claimant having succeeded in its claim, I order that the named defendants shall be
jointly and severally liable for the claimant's costs of the proceedings, such costs to be
subject to detailed assessment on the standard basis if not agreed. Liberty is reserved to
any defendant to apply in writing within 28 days of the handing down of this judgment
for a different costs order

Lots of people have asked me why there’s no enforcement on planning matters, so at Full Council today I asked a series of questions only to find out that there are 1200 outstanding enforcements and a backlog of up to 18 months! Developers are running circles around the council and more resources needs to be put into just basic enforcement!
