მაკა (სახელი შეცვლილია იდენტიფიცირების თავიდან აცილების მიზნით) 8 თვის ორსული იყო, როდესაც ხელმძღვანელის ბრძანებით სამსახურიდან გაანთავისუფლეს. ის ყოველთვის მოტივირებული თანამშრომელი იყო და დიდი გულმოდგინებით ასრულებდა სამუშაოს. განთავისუფლებამდე მაკამ ხელმძღვანელს მიმართა დეკრეტული შვებულებით სარგებლობის თხოვნით. მან მოთხოვნის დაკმაყოფილებაზე უარი განუცხადა და მოსთხოვა საკვალიფიკაციო ტესტირების ჩაბარება.

“შოკირებული ვიყავი ხელმძღვანელის ჩემდამი დამოკიდებულებით მას შემდეგ, რაც მან ჩემი ორსულობის შესახებ შეიტყო, დეკრეტული შვებულების დაკმაყოფილებაზე მაშინვე უარი მითხრა, ხოლო რამდენიმე წუთში ისევ დამიბარა და კონკრეტული პირობა წამიყენა: იმისთვის, რომ სამსახურში დავრჩენილიყავი საკვალიფიკაციო ტესტირება უნდა ჩამებარებინა. განერვიულებულმა განცხადება დავწერე და სამსახურიდან გამოვიქეცი. სახლში მოსულმა, როდესაც გავაანალიზე ჩემი საქციელი, მივხვდი, რომ არასწორად მოვიქეცი და იურიდიული კონსულტაციისთვის საქართველოს პროფესიული კავშირების გაერთიანებას მივმართე”.

პროფკავშირების იურისტის თამარ სურმავას დახმარებით მაკამ სასამართლოს მიმართა, რომელმაც მიიჩნია, რომ ხელმძღვანელის ბრძანება მისი სამსახურიდან გათავისუფლების თაობაზე იყო უკანონო, დაუსაბუთებელი და ბათილად იქნა ცნობილი. მოპასუხეს მაკას სასარგებლოდ დაეკისრა იძულებითი მოცდენის ანაზღაურება.

The GTUC also developed the initiative on the same issue and submitted it to the Parliament two years ago.
