אנחנו, עשרות אלפי ישראלים, כותבים אליך וקוראים להשית סנקציות על היועצת המשפטית לממשלה של מדינת ישראל, גלי בהרב-מיארה, ועל נשיא בית המשפט העליון של ישראל, יצחק עמית, וזאת כדי לחלץ את הדמוקרטיה הישראלית ממה שאנו רואים כמרד של המערכת המשפטית כנגד ריבונות העם.
כידוע לך, ראש ממשלת ישראל נרדף על ידי התביעה הכללית בהליך שלטענת רבים הוא פוליטי וחסר יסוד משפטי מוצק, כפי שהדבר נחשף במהלך המשפט. השופטים עצמם הציעו לתביעה הכללית להסיר את סעיף השוחד, ושאר העבירות לכאורה נוגעות לטענות בדבר סיגרים ושמפניה שקיבל מחברים בהיקפים מוגבלים. כמי שחווה בעצמך רדיפה פוליטית מצד מערכת תביעה שנשלטה בידי יריב פוליטי, וכמי שמודע לשימושים דומים בכוח התביעה בברזיל נגד הנשיא לשעבר בולסונרו ובצרפת נגד מארין לה פן, ברור כי אחת הדרכים האפקטיביות לריסון ניצול לרעה של כוח התביעה היא באמצעות הטלת סנקציות ממוקדות.
בית המשפט העליון בישראל נטל לעצמו סמכות לפסול תיקונים חוקתיים ללא הסמכה מפורשת בחוק. הוא מתערב במינויים ציבוריים בהיקף רחב על בסיס עילת ה"סבירות". במקביל, היועצת המשפטית לממשלה, בהרב-מיארה, עוסקת לדעת רבים ברדיפות פוליטיות כלפי הנהגת הימין. לאורך שנים הפעילו רשויות האכיפה גם תוכנות ריגול פולשניות, שבחלק מהמקרים נטען כי נעשה בהן שימוש בתיקים הנוגעים לראש הממשלה. כאשר הוקמה ועדת חקירה ממשלתית לבחינת הפרשה, מהלכי היועצת המשפטית לממשלה ונשיא בית המשפט הובילו, בפועל, להתפטרות חברי הוועדה המכובדים.
אנחנו מודעים לכך שבקשתנו, כאזרחי מדינת ישראל, היא חריגה ועלולה להיתפס כפגיעה בריבונות המדינה. ואולם, רבים בציבור הישראלי חשים כי הריבונות הדמוקרטית נשחקה. ממשלה הנהנית מרוב ציבורי מובהק מתקשה להתמודד עם בית משפט הנחשב בעיני רבים לאקטיביסטי ביותר בעולם הדמוקרטי ומתערב בסוגיות ביטחוניות, פוליטיות ובמינויים בהיקפים חריגים.
ישראל מתפוררת, והדיפ-סטייט הישראלי חותר גם תחת האינטרסים האמריקאיים. הוא מחליש מבפנים את בת הברית המרכזית של ארצות הברית במזרח התיכון, ומונע את שיתוף הפעולה הקריטי בין ראש ממשלת ישראל לבינך כדי להשיג את המטרות המשותפות לשני העמים החופשיים שלנו.
לפיכך, אנחנו קוראים לך להשית סנקציות על גלי בהרב-מיארה ועל יצחק עמית, בדומה לסנקציות שהוטלו בעבר על שופטי בית הדין הפלילי הבינלאומי בהאג (ICC) ועל התובע הראשי כרים קאן.
לדעתנו, צעד כזה יתרום תרומה משמעותית לחיזוק הדמוקרטיה הישראלית.
אנחנו מודים לך על הקשב ועל פועלך למען העולם החופשי ולמען עם ישראל.

To the President of the United States, Donald J. Trump,
We, thousands of Israeli citizens, who have signed here, write to you and call for the imposition of sanctions on Israel’s Attorney General, Gali Baharav-Miara, and on the President of the Supreme Court of Israel, Yitzhak Amit - in order to help rescue Israeli democracy from what we view as an institutional revolt against the sovereignty of the people.
As you know, Israel’s Prime Minister has been persecuted by the state prosecution in a case that many believe is politically motivated and lacking solid legal foundation, as developments during the trial have exposed. The judges themselves suggested that the prosecution withdraw the bribery charge, while the remaining allegations largely concern claims regarding ci**rs and champagne allegedly received from friends in limited quantities.
As someone who has personally experienced political prosecution by a legal establishment captured by political rivals - and who is aware of similar uses of prosecutorial power in Brazil against former President Bolsonaro and in France against Marine Le Pen - you understand that one effective way to curb abuses of prosecutorial power is through targeted sanctions.
Israel’s Supreme Court has assumed authority to invalidate constitutional amendments without explicit constitutional authorization. It intervenes extensively in public appointments based on what it terms the “reasonableness” doctrine. At the same time, Attorney General Baharav-Miara is, in the view of many, engaged in politically driven actions against right-wing leadership. Over several years, law enforcement authorities also deployed intrusive surveillance tools, which in some cases were reportedly used in matters connected to the Prime Minister. When a governmental commission of inquiry was established to investigate this affair, actions by the Attorney General and the Court effectively led to the resignation of the commission’s distinguished members.
We are fully aware that our request as citizens of Israel is unusual and may be perceived as implicating issues of sovereignty. However, many Israelis believe that democratic sovereignty has been significantly eroded. A government enjoying a clear public mandate is struggling to function in the face of what many view as the most activist high court in the democratic world — one that intervenes deeply in security, political, and appointment matters.
Israel is unraveling, and Israel’s deep state is acting in ways that undermine American interests. It weakens the United States’ central ally in the Middle East and obstructs the critical cooperation between Israel’s Prime Minister and you in advancing the shared objectives of our two free peoples.
Accordingly, we call upon you to impose sanctions on Gali Baharav-Miara and Yitzhak Amit, similar to measures previously directed at judges of the International Criminal Court (ICC) in The Hague and its chief prosecutor Karim Ahmad Khan.
We believe such action would make a meaningful contribution to strengthening Israeli democracy.
We thank you for your attention and for your continued leadership in support of the free world and the people of Israel.
