हाई कोर्ट ने कहा है कि एक व्यक्ति को कानूनन अधिकार है कि वह अपनी आय के ज्ञात स्रोतों से अपने पत्नी के नाम पर अचल संपत्ति खरीद सके। इस तरह खरीदी गई प्रॉपर्टी को बेनामी नहीं कहा जा सकता। हाई कोर्ट ने कहा कि ऐसी संपत्ति का मालिक वही कहलाएगा, जिसने उसे अपनी आय के ज्ञात स्रोतों से खरीदा, न कि जिसके नाम पर वह खरीदी गई।
