Provision of law for levy of maintenance charges in Housing Societies

Article 13(3)(a) indicates “law” includes any Ordinance, order, bye-law, rule, regulation, notification, custom or usage having in the territory of India the force of law;
Accordingly Bye-laws 65 – 71 cover various activities which can be covered for levy of maintenance charges. Some of which are listed as under:
(i) Property Taxes, (ii) Water Charges, (iii) Common Electricity Charges, (iv) Contribution to Repairs and Maintenance Fund, (v) Expenses on repairs and maintenance of the lifts of the Society, including charges for running the lift. (vi) Contribution to the Sinking Fund, (vii) Service Charges, (Viii) Car Parking Charges, (ix) Interest on the defaulted charges, (x) Repayment of the installment of the loan and interest, (xi) Non-occupancy Charges, (xii) Insurance Charges, (xiii) Lease rent, (xiv) Nonagricultural tax. (xv) Education and Training Fund (xvi) Election Fund (xvii) Any Other Charges
Basis on which some of the above charges are fixed
• Expenses on repairs and maintenance of the building/buildings of the Society. At the rate fixed at the general body from time to time, subject to the minimum of 0.75 percent per annum, of the construction cost of each flat for meeting expenses of normal recurring repairs.
• Expenses on repairs and maintenance of the lift, including charges for running the lift. Equally by all the Members of the building in which lift is provided, irrespective of the fact whether they use the lift or not.
The following repairs and maintenance of the property of the Society shall be carried out by the Society at its costs:
(i) All internal roads, (ii) Compound walls, (iii) External water pipe lines, (iv) Water pumps,(v) Water storage tanks, (vi) Drainage lines, (vii) Septic tanks, (viii) Stair cases, (ix) Terrace and parapet walls, (x) Structural repairs of roofs of all flats, (xi) Stair-case lights, (xii) Street lights, (xiii) External walls of the building/ buildings, (xiv) All leakages of water including leakages due to rain water, and leakages due to external common pipe line and drainage line, (xv) Electric lines upto main switches in the flats (xvi) Lifts, (xvii) The damaged ceiling and plaster thereon in the top floor flats, on account of the leakage of the rain water through the terrace.(xviii) Generators,(xvix) Security Appliances (CCTV, Intercom, Group Mobile, Mass Data Sharing Devices, Siren Bell) (xx) Rain Water Harvesting,(xxi) Sewerage, Storm water Drain & Water Treatment Plant (xxii) Common areas not specifically allotted ,Swimming Pool, Gym, Sauna Bath, Coffee House (xxiii) Common Parking Space (xxiv) Solar and alternate energy devices. (xxv) Garden (xxvi) Community hall...

Structural for Housing Societies
Society bye law no. 77 specifies Structural Audit as a mandatory (necessary and binding to Society) requirement. It stipulates that if the age of a building is 15 to 30 years, Structural Audit must be carried out once in 5 years and for buildings older than 30 years, it should be carried out once in 3 years.
Structural Audit is commissioned by appointing a Panelled Consulting Structural Engineer registered with the BrihanMumbai Municipal Corporation (BMC) and or Navi Mumbai Municipal Corporation (NMMC) or Thane Municipal Corporation (TMC). The Consultant carries out as a visual survey of the building covering its Terrace top areas to, external faces, stilts, staircase internals, inside flats, shops establishments and ancillary structures such as Lift room, pump room, compound wall, etc. Critical observations, probable causes of distress, remarks on structural health and recommendations for further action are given in the Structural Audit Report. Non Destructive test (NDT) recommended on need basis. On completion, shall provide Structure Stability certiificate.
As per the Mumbai Municipal Act, there is a provision to penalize owners if they do not submit the report within one month, senior civic officials said.
“If the occupant or owner living in dilapidated structures does not submit the report within one month after receiving the BMC notice, we have the provision to impose fines on them,” said Chakrapani Alle, assistant municipal commissioner. Also even the building resident or any member from the public can complain to the municipal authorities under section 353(B) intimating them the need and to issue a notice to carry out structural audit
The ex*****on of rules and regulations of structural Audit falls within the purview of Building and Factory department of the Municipal Corporation.
In case the Structural Audit is not undertaken then the Corporation can impose fines and penalties and also cancel/withdraw the occupation certificate. Also legal proceedings can be initiated by the corporation under the MMC Act as well criminal proceedings under the Indian Penal Code.

Maharashtra Cooperative Societies Act, Membership clarifications

Based on following articles from the constitution
37. The provisions contained in this Part shall not be enforceable by any court, but the principles therein laid down are nevertheless fundamental in the governance of the country and it shall be the duty of the State to apply these principles in making laws.
43. The State shall endeavour to secure, by suitable legislation or economic organisation or in any other way, to all workers, agricultural, industrial or otherwise, work, a living wage, conditions of work ensuring a decent standard of life and full enjoyment of leisure and social and cultural opportunities and, in particular, the State shall endeavour to promote cottage industries on an individual or co-operative basis in rural areas.
Brief provisions under The Maharashtra Cooperative Societies Act, 1960 for membership, rights and duties
22. An Individual competent to contract can become a member
23No society shall, without sufficient cause, refuse admission to membership to any person duly qualified therefore under the provisions of this Act and its bye-laws.
Recent Amendments
(18) “Member” means a person joining in an application for the registration of a housing society which is subsequently registered, or a person duly admitted to Membership of a society after its registration and includes associate or joint or provisional Member ;
( a) “Associate Member” means husband, wife, father, mother, brother, sister, son, daughter, son-in-law, daughter-in-law, nephew, niece a person duly admitted to Membership of a housing society on written recommendation of a Member to exercise his rights and duties with his written prior consent and whose name does not stand in the share certificate ;
( b) “Joint Member” means a person joining in an application for the registration of a housing society jointly, which is subsequently registered or a person who is duly admitted to Membership after its registration and who holds share, right, title and interest in the flat jointly but whose name does not stand first in the share certificate ;
( c) “provisional Member” means a person who is duly admitted as a Member of a society temporarily after death of a Member on the basis of nomination till the admission of legal heir or heirs as the Member of the society in place of deceased Member ;
