The name of the union shall be RASHTRIYA RAKSHA KARMACHARI SANGH, affiliated to BHARATIYA MAZDOOR SANGH (Central Labour Organization) and BHARATIYA PRATIRAKSHA MAZDOOR SANGH (A Recognized Federation of MoD, Govt. The address of the union shall be 25/32/33, Ibrahim Manson, Dr. B R Ambedkar road, Parel, Mumbai – 400012. (A) the objects of the union shall be
(a) The objects of the union shall be to
organize and unite the civilian employees of NAVY, Mumbai and to regulate their relation with their employer. (b) To secure to the members fair conditions of life and service. (c) To try to redress their grievances. (d) To try to prevent any reduction of wage, and if possible to obtain an advance whenever circumstances allow. (e) To endeavor to settle disputes between employer and employees amicably so that cessation of work may be avoided. (f) To endeavor to provide assistance/financial help against sickness, unemployment, infirmity, old age and death. (g) To endeavor to secure compensation for members in case of accident under the workman compensation Act. (h) To provide legal assistances to the members in respect of matter arising out of or incidental to their employment. (i) No member of the union shall strike work without the permission and specific direction of the Executive committee and any member who acts in contravention of this rule shall not be entitled to any help and shall also be subject to such disciplinary action as may be decided upon by the Executive Committee. The Executive Committee of the union shall be the sole authority to call for and conduct a strike and such action shall be taken by the Executive Committee only after exploring all possible avenues for the settlement of disputes open to it and also those provided for in the Industrial Dispute Act, 1947, and such other laws as may be framed by Government from time to time and, in particular, no strike shall be called unless at least 75 percent of the members of the Union have voted at a Secret Ballot, specially conducted for the purpose and three fourths of the votes so polled favour the calling of a strike. Further, no strike shall be called for unless the Union gives a proper notice of strike to the authorities concerned. The Labour Officer of the installation concerned shall invariably be associated in any strike ballot which the Trade Union may conduct. And to endeavor to render aid to members during and strike brought about with the sanction of the union or lockout. (j) To obtain information in reference to the civilian employees of Navy, (Mumbai) industry in INDIA. (k) To cooperate with organizations (of labour) particularly those having similar objects in INDIA. (l) To help in accordance with the Trade Unions Act, the working class in India in the promotion of the objects mentioned in the rules, and
(m) Generally to take such other steps as may be necessary to ameliorate the social economic and civic conditions of members and to educate the members in trade union movement and such other branches of knowledge which will be helpful to them in their everyday life and work by conducting classes of workman under Central Board for workers education scheme or with help of any other body of similar objects. (n) For the attainment of these objects, the union may organize centers in various localities. ADMISSION OF ORDINARY MEMBERS
3. Any person (Industrial, Non Industrial and Ministerial) employed in units of HQ WNC, Mumbai, who has attained the age of 18 years, shall be entitled to become an ordinary member of the union on payment of an admission fee NIL and an annual subscription of Rs.50/- (Rs. Fifty only) Abiding by the existing Govt. of India orders/rules and any modification in such orders/rules thereon, time to time. Provided he / she agrees to abide by rules and bye laws that may be made by the union from time to time. And the union has the provision to receive / collection of fighting funds for fighting the cases etc. for the welfare of the employees/ members of union. ADMISSION OF HONORARY MEMBERS
4. Persons who are not eligible to become the ordinary members of the union may be admitted as honorary member of the union for the purpose of being elected or co-opted to the managing committee and they shall be honorary member of the union during the period of their office. Subject to the provisions of section 22 of the Trade union Act, 1926. Their number shall not exceed 04 (four) who will activist of BHARATIYA MAZDOOR SANGH
FINE AND FORFITURES
5. A member failing to pay his monthly subscription for six months with the permission of managing committee or three months without the permission of the said committee shall continue to be a member of the union,. On expiry of the above said period the membership would be ceased. But he shall be entitled to rejoin the union on paying his arrears. No members of the union shall be entitled to any benefits that the union may decide to give to its members unless he has been a member for at least for six months and has paid all contribution.
7. A member of the union who is in arrears with his subscription or dues shall not be entitled to any benefit until all arrears have been paid and a period of two months has elapsed from the date of payment of such arrears.
8. If the member of the union go on strike without the sanction or approval of the managing committee they shall not be entitle to any benefits what so ever. REGISTER OF MEMBERS
9. The union shall keep a register of all its members containing their names and particulars of their place of work, their residence etc.
10. The register shall be open to inspection by any member or an officer of the union at the head office during the hours, during which the office of the union is on any working day excluding holiday.
11. The union shall have a President, 05 (five) Vice Presidents, 01(one) General Secretary, 01 (one) Jt. General Secretary and 05 (five) secretary, 01 (one) Treasurer and 12 (twelve) Organizing secretary and union shall have its managing committee up to one hundred including office bearers. All of them shall be elected with simple majority by raising hands at the annual general meeting of the union for two years and they shall be eligible for re-election.
11A.The Union may have branches at all the units of HQ WNC, Mumbai. Each branch shall have 01 President, 02 Vice president, 01 Secretary, 02 Organizing Secretary, 01 Treasurer and 15 other members as executive committee elected at the annual general meeting of the respective branch. The branch may have correspondence with the local authorities but in case of any contradiction in any matter between the branch office and main office the correspondence made by main office will final and shall supersede to the correspondence made by the branch office.
12. Subject to provisions of section 21 of the Trade Union Act, 1926. The affairs of the union, financial and otherwise, shall be conducted by a managing committee consisting of the office bearers and executive members elected at Annual General Meeting. The managing committee will continue functioning till new one is elected. VACANCIES AND REMOVAL
13. Should a vacancy occur among the office bearers and of the members of the managing committee it shall be filled by the managing committee by co- option.
14. Any member office bearer of the union or a member or its managing committee can be removed by the general meeting of the members by simple majority for committing any fraud or having acted against the Interest of the union, provided the office bearer of the member to be removed is given adequate opportunity to explain his conduct. MEETING OF THE MANAGING COMMITTEE
15 The managing committee shall meet once a month on such days and at such place as may be fixed by the General Secretary in consultation with President.
16. The presence of at least one- third members of the managing committee shall be necessary to form quorum, no quorum is necessary for adjourned meeting.
17. At least three days notice shall be given for a meeting of the managing committee. DUTIES OF OFFICE-BEARERS
The President & the Vice President
18. The president shall preside over all meetings of the union and the managing committees preserve orders, sign all minutes and shall be allowed to give a casting vote only. The President shall have the power if necessary to call a special meeting of the managing committee or the union whenever necessary, one of the Vice President shall function in place of president in his absence AND the president shall have power to co-opt the vacant post of office bearer with the consultation of its existing body and also shall have power to expel any member of the union if he dose anti-union activities with the consultation of office bearers of the union. The General Secretary
19. The General Secretary shall take minutes of general meetings and committee meetings, conduct all correspondence, convene all meetings, keep all account exercise supervision over the affairs of the union and shall also keep a correct account of all receipts and expenditures. He shall prepare a balance sheet annually showing clearly ever item of receipts and expenditure.. He shall be responsible for submitting to the Registrar of Trade union all notice that should be sent to that officer under the Trade Union Act 1926.He shall have power to engage in consultation with President an subject to approval and confirmation of the managing committee, any assistance for organizing and clerical purpose be necessary and assistance shall be under the control of General Secretary. 20. The secretary shall generally help the General Secretary / Jt. General Secretary in his work. One of them shall perform the duties of the Gen.Secy./Jt.Gen.secy. In his absence. The Treasurer
21. The Treasurer shall be responsible for all sum of money which may from time to time be paid into the union and for duly banking them He shall make payment towards all expenditures sanctioned by the committee. He shall not have the power to draw money from the banks without first having the cheque signed by president or the Gen. GENERAL MEETING
22. There shall be held in the month of March or April, annual General meeting of all members of the union could conduct the following business. (a) To adopt the report of the work done by the union and the audited statement of accounts
(b) To elect the office bearers or the members of the managing committee biannually. (c) To transact such other business as may be brought forwarded with the permission of the chairman.
23. The President or General Secretary may call a general meeting of the member of the union whenever he think necessary and shall call it on a requisition signed by one- fifth of the total strength of the union within twenty days of the receipt of the requisition. In case the President or the General Secretary fails to convene such a meeting, the requisites themselves shall call the meeting after due notice and the proceedings of the meeting shall be binding on the union.
24. At least fifteen days notice shall be given to the members for the General meetings.
25. The presence of at least one- third members shall be necessary to form a quorum at General meeting .No quorum is necessary for adjourned meeting. GENERAL FUNDS
26. The general funds of the union shall consist of the subscription/ fighting funds and donation from the members. They shall be deposited in the NATIONALIZED Bank approved by managing committee in name of the union and accounts shall be operated by treasurer / Assistance treasurer and any one of the President or General Secretary / Secretary. The General Secretary / Secretary or the treasurer shall not keep more than Rs. 1500.00 (One thousand five hundred) with him for current expanses. OBJECTS ON WHICH THE GENERAL FUNDS CAN BE EXPENDED
27. Subject to the provision of section of the trade union Act, 1926 .The General funds of the union shall not be spend on any other objects than the following viz:
(a) The payment of salaries, allowances to offices bearers of the union. (b) The payment of expenses for the administration of the union including
Audit of the accounts of the general funds of the union
(c) The prosecution or defence of any legal proceeding to which the union
or any member thereof is party when such prosecution or defence is under taken for the purpose of securing or protecting any rights of the union as such or any rights arising out of the relation of any member with his employer or with a person whom the member employees. (d) To conduct trade dispute on behalf of the union or any member thereof. (e) Compensation to member for less arising out of trade disputes. (f) The compensation to members or their dependents on account of death, old age, sickness, accident or unemployment of such members. (g) The issue of the undertaking of liability under policies of assurance on the lives of the members, or under policy insuring members against sickness accident or unemployment
(h) The provision of educational, social or religious benefits for member. (Including the payment of the expenses of funeral or religious ceremonies for deceased members or for the dependents of members)
(i) The upkeep of periodical published mainly for the purpose of discussing questions affecting employer/ workman/ s as such. (j) The payment in furtherance of any of the object on which general funds of the union may spent of contributions to any cause intended to benefit workman in general, provided that the expenditure in respect of such contribution in any financial year shall not at any time during that year be in excess of one– fourth of the combined total of the gross income which has up to on that time accrued to the general funds of the union during that year and of the balance at the credit of these funds, at the commencement of that year and.:
(k) Subject any condition in the notification, any other object notified by the appropriate Govt. in the official Gazette. ANNUAL AUDIT
28. The union shall make due provision for the annual audit of the account of the union by competent auditors appointed by the managing committee in accordance with rule 18 of the Bombay Trade Union Regulations, Act, 1927
INSPECTION OF BOOKS OF ACCOUNTS
29. The book accounts of the union shall be open to the inspection by any member/ officer of the union at the head office of the union during the hours, during which the office of the union is open on any day excluding holidays. AMENDMENT OF RULES
30. The rules may be amended, altered, replaced, or rescinded or added at any time by majority of the members present at a general meeting, provided previous notice of at least seven days is given to the member of the proposed alternations. DISSOLUTION OF THE UNION
31. The union shall not be dissolved except by the vote of majority of three-fourth members present at general meeting called for the purpose, provided the total number of votes cast at a meeting is not less than two-third of the total number of the members then on the rolls of the union. The funds of the union after meeting all the liabilities shall be disposed off in accordance with decision of the dissolution meeting. General Secretary. RASHTRIYA RAKSHA KARMACHARI SANGH

Any industrial (Viz: highly skilled/skilled/Semi-skilled and unskilled labours) and Non industrial ( telephone operators/MTDrivers/Fire-fighting staff/Yard Craftstaff/ peon/Dhobi, Mali) and similarly placed categories of GP ‘C’ and ‘D’ civilian employees working in units of HQ WNC,
Mumbai, industry who has attained the age of 18 years, shall be entitled to become an ordinary member of the union on payment of an admission fee NIL and annual subscription Rs.50 ( Rs. Fifty only) provided he / she agrees to abide by rules and byelaws that may be made by the union from time to time. Amendment

1. To get approval of minutes of previous AGM.
2. General Secretary Report.
3. To get approval of accounts for the year ending 2010.
4. To pass the Resolutions for amendments in the Rule No.3 and insert Rule No.11A
5. Any other issue with permission of chair. The said General Meeting if adjourned for want of quorum, the adjourned meeting shall be held after half an hour at the same place and venue for which no quorum shall be necessary.
