First of all, if the payee has served you a 138 Cheque Return Notice, you must serve him a legally Sound Reply to Notice. For drafting proper reply the same you are advised to consult an Experienced Cheque Return Advocate.

Secondly, if genuinely your cheque has been misused without your permission, you must immediate file Police FIR.

These two basic steps will go a long way in proving your innocence in court of Law.

20% Interim Relief in Cheque Return Matters
Dear Friends,
If you have a cheque that has been returned by Payor's Bank for reason of "Insufficient Funds".. and if you file Criminal Complaint u/s 138 of NIA,
Court would order accused to pay 20 % interim compensation to you / complainant.
If your Advocate has not asked for it, pl tell your advocate to request the H'ble Court to issue such order in your favor.
