Sub: Appeal for assent of mandatory Scheduled Tribe certificate for participation in the GHADC elections.

Respected Governor,
It is with great hope, the indigenous people of Garo Hills and with support from many indigenous tribals of Garo Hills and North East India respectively, we wish to put forth our grievances for your kind contemplation and perusal on the matter as defined in the subject matter. The GHADC exists as an extension of the very special part to the Constitution of India; the 6th Schedule, which exists for the very purpose of preservation and protection of our own Garo language, land, identity, culture, forests, resources, customary laws, traditions, customs and another very important aspect; the protection of socio-political identity.
The Assam and Meghalaya (Autonomous District Council) Rules 1951 has an anomaly which contradicts the spirit, guidelines and principles of the core purpose of the 6th Schedule to the Constitution of India. The participation of the non-tribals in the GHADC elections is the anomaly. This anomaly combined with the consequences of the drastic demographic change in the west plain belts of Garo Hills due to influx of illegal Bangladeshi muslim immigrants not only ensures the dilution of the inviolable protective provisions of the 6th Schedule but it has and will have far reaching negative impacts which will pose an existential threat if the trajectory is not corrected.
The 17th February 2026 notification by the GHADC regarding the need for ST certificate validity for participation in the GHADC elections is a desperate attempt to conjugate legislative precedence meaning to arrest and address the necessity of at least protecting the socio-political identity of the indigenous peoples of the region. This anomaly is the perfect antithesis to the guidelines and principles of the 6th Schedule guided asymmetric federal grassroots institution for autonomous self-governance.
The Constitution under Article 342 empowers the President of India to specify the tribes or tribal communities deemed to be Scheduled Tribes in relations to a particular State. In the State of Meghalaya, the indigenous tribal communities such as the Garos, Khasis and Jaintias have been notified as Scheduled Tribes under Article 342. The constitutional scheme therefore clearly distinguishes between:
a. Scheduled Tribe inhabitants of protected tribal areas, and
b. Non-tribal persons residing within such areas.
The purpose of such distinction is to ensure special constitutional protection for indigenous tribal populations.
The Hon'ble Supreme Court of India has consistently upheld the constitutional objective of protecting tribal communities and their land and governance systems. The Hon’ble Supreme Court held and recognized that:
In Samatha V. State of Andhra Pradesh:

“The Constitution intends to protect tribal autonomy, culture and economic empowerment, and the State must ensure that tribal interest are not compromised.”

In State of Kerala v. N.M. Thomas:

“Special provisions in favour of disadvantaged or historically marginalized communities are constitutionally valid and consistent with the principle of equality. These judicial pronouncements affirm that protective discrimination and special governance arrangements for tribal communities are constitutionally justified.”

Though 6th Schedule does cultivate the idea of creating a realm for the indigenous tribes to preserve its identity and culture which validates the consensus of prosperity and elevation of the indigenous tribes, the prevalent practice in the district council elections have been the usage of the Meghalaya Electoral Rolls for the Assembly elections as per the Assam and Meghalaya Autonomous Districts (Constitution of District Councils) Rules 1951. Therefore,
A). The District Council must have:
A separate electoral roll or for which the addendum must be the mandatory possession of the ST certificate to contest ADC elections. The basic point is the precedent of allowing non-tribal to vote and contest in the ADC elections since 1952 which is clear violation of the principles and guidelines of the 6th Schedule. This particular oversight needs to be amended and restructured. The protective provisions of the schedule to avoid exploitation of the indigenous tribal is sacrosanct.

ADCs must have its own separate electoral roll, its own election commission which must be able to function without undue interference from the state govt in the conduct of its elections.

Another point could be the feasible possibility to amend the para 12(a) and further amend the constitution to include the ADCs’ C.E.M.s as the council of ministers of the governor.This paragraph subordinate the ADCs to gubernatorial oversight to mitigate risks of administrative overreach or conflict with national security imperative but which the Meghalaya state govt takes full advantage for full control.

B). Chapter II- Franchise-Electoral Rolls ( The Assam and Meghalaya(Constitution of District Councils)Rules, 1951):
In the rule 128 (1). (a) the words “ indigenous Scheduled Tribe of Garo Hills ” should be inserted to elucidate as
“an indigenous scheduled tribe of Garo Hills, a citizen of India and ordinarily resident in a constituency for not less than 180 days during the qualifying period. ”

C). Part II- District Council-Composition-Executive Committee-Chapter 1- General:
In this part “qualifications for membership” para 8. (a). must be amended to insert the words “ Indigenous Scheduled Tribe of Garo Hills” as
“an indigenous scheduled tribe of Garo Hills, a citizen of India.”
D). Contradictions on legitimacy of illegal Bangladesh immigrants:
The temporary Periodic (Maidi) patta implemented according to Assam Schedule # # Form.19 (c) & J.- Periodic Khiraj Lease (for use in Garo Hills) is valid for 10 years only, subject to renewal at the term end.
The Chapter II-Franchise-Electoral Roll Rule 128 (3) states that a person to be considered permanently resident within the territorial limits of an autonomous district must have resided in a scheduled area for not less than 12 years on the qualifying date. And in the context of Rule 4(b) of Chapter II-Franchise –Electoral Rolls the following is the content
“in the case of every electoral roll subsequently prepared under these rules shall be the first day of March of the year it is prepared….”
The first preparation of the electoral roll should be in the year 1952 since it was the year of the first ADCs’ elections. With disruptions to the GHADC elections it was held in 2021 and it is now possibly scheduled to be held in 2026. The argument is based on “qualifying date and qualifying period” relative to the Periodic (Maidi) lease patta of land held by the non-tribals which will be expiring on 31st March 2026.
To be eligible to vote according to the chapter II-128(3) content a voter must also be considered a permanently resident citizen but as specified in rule 128(1) a voter must be permanently resident for a period of not less than 12 years. Since the Periodic (Maidi) Lease patta of the non-tribals is only for 10 years the position of the non-tribals voters to be considered “permanently resident” is in question as they have not permanently resided for continuous 12 years. Thus, from the above sentence, it can be construed and explicitly stated that since the non-tribal are not “permanently resident” hence, they are not eligible to vote.
The words “precedent” and “practice” with regards to participation of the non-tribal in the district council elections since 1952 does not mean rules as it is neither a constitutionally specified legal precedent nor should it be incorrectly called a tradition which dilutes the provisions and guidelines of the schedule when analyzed from the core point. The govt. of Meghalaya must hear the demands supported by the majority of the Garos as it can have a consultation with the Governor of Meghalaya for assent and publish it the Meghalaya Gazette because rule 128 election rules can be amended. Rules of utmost importance concerning the protection of the indigenous tribes passed by the council must be respected without an inch for inch interference by the state govt by incessantly invoking the paragraph 12(a) of the 6th schedule.
Further, there should be a special provision to include the C.E.Ms. of the ADCs to in the DCA for better participation and induction for specific observations of ground facts pertaining to particular needs and demands which is under the jurisdiction of the ADCs so that better establishment of rules to protect the indigenous tribes can be pursued.
Respected Governor, we plead upon you, on behalf of the indigenous tribes of Garo Hills, to fulfil our wishes so that we can remain as a unique indigenous peoples of the region to prosper and propagate under the guidance of the Indian Constitution and India. We beg your gracious attention on the matter and hope for a satisfying resolution on the matter without the need to face existential threat as citizens of India. Thank You

No, PAI(Panchayat Advancement Index) is not a scheduled area; the term refers to the Panchayats (Extension to Scheduled Areas) Act, 1996, and while it aims to extend Panchayati Raj to tribal areas, it applies to areas under the Fifth Schedule, not the Sixth Schedule.
The Sixth Schedule, which applies to tribal areas in Assam, Meghalaya, Tripura, and Mizoram, protects the autonomy of these regions and excludes them from the direct application of the Panchayati Raj system to preserve local customs and institutions.
PAI applies to "Scheduled Areas" which are those designated under the Fifth Schedule of the Constitution.
The Sixth Schedule explicitly excludes its tribal areas from the application of the Panchayati Raj system, meaning PAI does not apply to these Sixth Schedule areas.

Regarding the recruitment for AYUSH doctors for Ampati reports are coming in that there is going to be fresh advertisement for the post. Let us watch because the appointment is supposedly going to be cancelled. If not there will be protests.
But the post requires a degree in Ayurveda, Yoga n Naturopathy, Unani and Homeopathy. From reports there were two Khasi who applied but no Garos.I hope qualified Garos will be given a chance to apply when fresh advertisement is published.
