CONSUMER RIGHTS OFFENDERS SUSPECTS IN COURTS

TWO Consumer Rights offenders have this morning been arraigned in Courts following complaints by members of the public of rampant sales of expired products; an offence punishable and prosecutable under the Consumer Protection Act no. 46 of 2012 Laws of Kenya.

The Consumer Protection Organization lodged complains with the National Police Service through the Kenya Police Service in Baricho Kirinyaga County and the matter was taken up by Sub- County Police Baricho who swiftly seized the expired goods and apprehended the offenders.

In the company of officials who identified the said premises, the Police apprehended the perpetrators who were charged in Baricho Law Courts on the 13th of November 2025.

The Office of the Director of Public Prosecutions Kenya through did not object the suspects plea for bail and each was granted a cash bail of Kshs 50,000 pending hearing. The Consumer Protection Act gives penalty of up to kshs 1 million if found guilty.

CONSUMER RIGHTS OFFENDERS SUSPECTS IN COURTS

The Consumer Protection Organization lodged complains with the National Police Service through the Kenya Police Service in Uasin Gishu and the matter was taken up by Sub- County Police Kitale who swiftly seized the expired goods and apprehended the offenders.

In the company of officials who identified the said premises, the Police apprehended the perpetrators who were charged in Kitale Law Courts on the 12th of November 2025.

The Office of the Director of Public Prosecutions Kenya through Ms. Judith Ayuma did not object the suspects plea and one was convicted on his own plea of guilt and fined kshs 70,000 with the exbits being the expired products set for destruction while the remaining four plea were deffered to a later date. The Consumer Protection Act gives penalty of up to kshs 1 million if found guilty.

COMMEMORATING THE CONSTITUTION OF KENYA 2010

CONSUMER PROTECTION UNDER ARTICLE 46 STATEMENT

On this 27th Day of August 2025 which marks 15 years of the promulgation of the Kenyan Constitution 2010, as is celebrated and universally acclaimed to be one of the most transformative and progressive constitution, today as every stakeholder delves in the areas affecting their sector,

The Constitution intends to safeguard the Consumers as enshrined in article 46.The benefits as enshrined should be enjoyed by CONSUMERS and any infringement therein is borne by the Consumers and it is important to note that it is the Consumers who suffer the violation of their rights under the Constitution with respect to this article and therefore they should be protected.

The Constitution further brought rise to the Consumer Protection Act no. 46 of 2012 Laws of Kenya in its strength to further protect Consumers. Parliament in its wisdom understood that this Act is special in its case and the power as is with the Constitution may be exercised directly by the Consumers while liaising with independent bodies, government agencies, authorities, established commissions and tribunals, and many others including the National Police Service and the Director Public Prosecution. The reason is because, the Act provides for criminal sections which the Consumer(s) must complain against when they are deprived of such rights. Some are Criminal in nature while others are Civil. For the criminal elements the Consumers must complain directly to the National Police Service being the Police Station nearest to where the offence has taken place. For the civil elements, the consumer must file a case within the same jurisdiction.

Indeed Consumer Protection has been neglected for the longest time and as an organization, we have engaged the upper gear to ensure going forward consumer affairs are going to be handled differently. In our unique standing where we are compelled to critisize the Government and still maintain the balance to work with the same institutions in attainment of Consumer Rights, we strive that even when subjecting the system to criticism it will not be personal but aimed to improve the servises delivered to Consumers.

We applaud and commend His Excellency the President for the move in marking this day in appreciation of our Constitution.
