“Hindi na natin afford paswelduhin ang mga tamad at palamunin tulad ng Malas na 13 ni Cayetano, habang naghihintay ang milyon-milyong commuters, interns, at kabataang inaasahang pumasok araw-araw para sa kanilang mga pamilya, kahit masakit na ang kanilang mga katawan at bulsa.

Hindi na natin afford ang gulong ito dahil ang tunay na nakaka-10,000 araw-araw ay si SP Cayetano, na dapat nang maibaba sa pwest, imbis na ang sambayanang literal nang nalilipasan ng gutom at oras.”

Valid examples: war, rebellion, natural disasters, epidemics, fires, blockades, strikes, and unforeseeable government actions.


IN THE SENATE: RULES AND CONTROVERSY

- 2020–2021: Resolutions allowed remote sessions during emergencies or genuine force majeure.
- May 2026: Senator Marcoleta proposed expanding remote attendance for “justifiable reasons,” amid high-profile absences and pending legal cases.
- May 26, 2026: Debate escalated over the proposal, linked to planned charges against senators in the flood control controversy. The minority walked out; session adjourned without quorum.


FACT CHECK: WHY “THREAT OF CONFLICT” IS NOT FORCE MAJEURE

Some claim risks like Middle East tensions, terrorism threats, or possible involvement in China-Taiwan issues qualify as force majeure. Legally, this is incorrect.

Force majeure requires actual impossibility, not just danger, uncertainty, or political sensitivity. A threat is not an event; a risk is not a barrier. The law does not excuse non-compliance simply because a situation is tense or worrisome.

Using force majeure as a catch-all for any concern stretches the law far beyond its original meaning. It is a strict legal exception — not a convenient escape clause.
