Detailed Procedures for Cross-Border Marriage Involving Chinese of China and Malaysian.

Applicable for【Male/Female - Malaysia (Malaysian side) or Male/Female - China (Chinese side)】

PART 1: Obtaining a Marital Statement (Single Status Certificate) in Malaysia:

It is easier to first register your marriage in China (i.e. getting the marriage certificate), and thereafter re-register the marriage in Malaysia. In order to do so, the Malaysian side should first obtain his/her Marital Statement in Malaysia. Once completed, you can proceed to the relevant provincial Civil Affairs Bureau (涉外民政局) of China to obtain the marriage certificate (Little Red Booklet).

【Documents & Procedures Required for Malaysian Marital Statement's Application】

Note: Commencing from March 2025, the validity period of the Marital Statement granted by JPN Malaysia has been extended to 6 months.

Required Documents:

- Copy of Malaysian ID card
- Copy of Chinese passport
- Copy of divorce certificate if Malaysian side is a divorcee.

Procedure:

(1) First, go to the headquarter of the National Registration Department of Malaysia (JPN - Putrajaya) at the first floor to get a Marital Status application form. The officer will give you two sheet of papers, one is the Marital Statement Application form, and the other is the Statutory Declaration form. For Statutory Declaration form, please request for two as you will need to submit the original Statutory Declaration form to the JPN, and the other to be translated into Chinese (depending on the submission to the different provinces in China, certain Civil Affairs Bureau do not required Statutory Declaration from Malaysia).

After obtained the forms, go to the Commissioner For Oaths located at the ground floor to get a queue number. The working hours of this Commissioner For Oaths operate only from 8:30 PM to 12:00 AM. and thus, be sure to leave for JPN earlier, or otherwise if the office of this Commissioner For Oaths closes, you may have to go to the courthouse across the street to take your Oaths. While waiting, fill out the forms and then have the Commissioner For Oaths to affirm on both the Statutory Declaration.

Return to the JPN, show the officer the completed forms and the affirmed Statutory Declaration (they'll give you one, and you are going to keep the other), get a queue number, wait for your turn, and then wait for the officer to process your Marital Statement. Please remember to remind the officer for issuing an Marital Statement in English version or otherwise you'll have to incur additional cost for English translation.

(Note 1: Application for a Marital Statement, apart from JPN in Putrajaya, it can also be made to the JPNs in other states headquarter such as Johor Bahru or Penang.)

(Note 2: In November 2024, it was reported that the JPN in Putrajaya no longer requires applicants to fill out Marital Statement application form, so obtaining only the Statutory Declaration form is sufficient.)

(2) After obtaining the original Marital Statement, if the JPN officer instructs you to have it authenticated by the Malaysian Ministry of Foreign Affairs, please hold on for a moment! You must not do so but should have the Marital Statement together with the Statutory Declaration now submitted for translation into Chinese by a translator. The translation must be handled by a translator recognised by both the Chinese Consulate and the Malaysian Ministry of Foreign Affairs; Court Interpreters are generally recommended. Translations not recognised by them will not be accepted.

(3) After obtaining these four documents [original Marital Statement, original Statutory Declaration, translated Chinese version of the Marital Statement, translated Chinese version of Statutory Declaration] (please take note on Note 2 below), look for a Notary Public to have these four documents notarised and compiled into a single notarised document under a notarial certificate.

(Note 1: To ensure a smoother acceptance at the China's Civil Affairs Bureau, it is strongly recommended to find a Notary Public who is capable to prepare a notarial certificate which is in both Chinese and English.)

(Note 2: Some provincial Civil Affairs Bureaus in China may require additional passport translation, as such, it is recommended to check and consult with the relevant Civil Affairs Bureau beforehand to determine if the passport translation is necessary to be notarised as well, which will effectively saving your time and the high translation fees if it were to be done in China.)

(Note 3: Even if the Chinese Consular in Malaysia has certified and legalised the translated documents prepared in Malaysia of which the relevant authorities in China should have no question to accept, nevertheless, some provincial Civil Affairs Bureaus may still require you to re-translate all documents locally for various reasons. Therefore, it is always a good practice to consult with the relevant Civil Affairs Bureau beforehand and also be prepared for such situations that may have eventually arisen.)

(Note 5: Compared to an authentication without a notarial certificate, one advantage of having the issuance of notarial certificate is that only one Chinese consular legalisation endorsement is needed, thus saving the Chinese consular fee which is calculated on per endorsement basis.)

(4) Proceed to take the notarised document to the Malaysian Ministry of Foreign Affairs for legalisation:

(5) After legalised by the Ministry of Foreign Affairs, proceed to the Chinese Consulate in Malaysia for final legalisation (submission on the 6th floor):

After completion, you are now ready to go to the relevant Civil Affairs Bureau where your future husband/wife's Chinese household registration is at to apply for your marriage certificate. You can get your certificate on the same day.

PART 2: Marriage Registration in China:

Documents required for marriage registration in China:

(1) For the Chinese side (Chinese citizen): Only registration is required. *Household registration book + divorce certificate (if applicable). Both copies and originals are required.

(2) For the Malaysian side (Malaysian citizen): Original Marital Statement (no copy needed). Passport, *Visa - both copies and originals are required.

(3) Photos for the marriage certificate to be taken at a photo studio. One set consists of 4 photos. The Civil Affairs Bureau requires 3 photos.

Marriage registration at the Civil Affairs Bureau in China is completely free of charge.

Finally, it must be emphasised that the above procedures only apply to Malaysian citizens who are "non-Muslims".

(Note 6: According to the new policy released in May 2025, the household registration book is no longer required.)

(Note 7: If the Civil Affairs Bureau requires a Malaysian visa, you can try to show a screenshot of the official announcement of 30-day visa-free period issued by the Chinese Consulate for Malaysian tourist.)

PART 3: Re-registration of Marriage Certificate in Malaysia: -

Generally required documents are (please confirm with the relevant JPN that the documents you need for the submission, there are slight difference of documents required by different offices):

(3) Marriage Certificate from China (entire booklet)
(4) Passport
(5) Copy of the entry stamp pages for China and Malaysia
(6) Photo (1 2-inch blue background passport photo)

(1) Marriage Certificate issued from China (Male or Female)

Chinese:
Original + Copy:

(1) Your own household registration booklets (except where your parents' household registration booklets being in the same book with yours) *Note: If your parents have deceased, provide with their death certificates as well.
(2) Please remember to have the marital status cited on the household registration booklet changed to "married".
(3) Passport
(4) Marriage certificate issued from China
(5) Photo (1 2-inch blue background passport photo)
(6) Copy of the pages showing the immigration entry and exit on your passport evidencing the date of your marriage in China and the return to Malaysia
(7) If you were previously divorced, your divorce certificate.
