*The State of Palestine welcomes the landmark ruling by the International Court of Justice on the “Obligations of Israel in relation to the Presence and Activities of the United Nations, Other International Organizations and Third States in and in relation to the Occupied Palestinian Territory.”*

The Court concluded that Israel has blocked humanitarian aid to the civilian population in the Gaza Strip in violation of its obligations as an occupying Power and a member of the United Nations, and in violation of its obligation not to impede the right of the Palestinian people to self-determination. The Court concluded that the limited aid Israel has allowed in has not alleviated the catastrophic situation in the Gaza Strip. The. Court recalled that Israel has also violated its obligation to respect the prohibition of use of starvation as a method of war and the forcible transfer and deportations of the Palestinian people and affirmed that Palestinians that have been evacuated should be transferred back to their homes.

The Court rejected Israel’s campaign of lies against UNRWA, that Israel has not substantiated its allegations and that the evidence before it confirms that impartiality and neutrality of UNRWA, and insisted that UNRWA can not be replaced. Israel is prohibited from taking actions against UN, including, UNRWA contrary to its obligations as a Member of the UN, and to respect inviolability of UN premises and not interfere with them. Israel is under an obligation to agree and facilitate relief schemes by UN, including UNRWA, to the Palestinian people. Israel is also obliged to respect the right of Palestinian detainees and allow them access to ICRC.

The Court reaffirmed that Israel enjoys no sovereignty over the occupied Palestinian territory, including East Jerusalem, and is not entitled to decide unilaterally with respect to the presence and activities of UN, third States and other organizations in occupied Palestinian territory, including East Jerusalem.
This ruling comes in the context of Israel’s genocidal war against the Palestinian people. Notwithstanding the recent declaration of a ceasefire, Israel is still using starvation as a method of war and weaponizing aid.

This ruling makes very clear that Israel must cease these illegal policies and that states have an obligation to bring Israel into compliance with its obligations in this regard. Israel must immediately lift the unlawful ban on UNRWA and allow all other international organizations invited by Palestine to operate freely and safely in Gaza and the rest of the Occupied Palestinian Territory, including East Jerusalem.

The State of Palestine calls on Israel, the illegal occupant, all States and the international community at large to uphold their legal obligations and to implement the Court‘s ruling as well as previous rulings. Adhering to these advisory opinions and to international law is the only path towards ending the suffering of the Palestinian people, achieving peace and security in the region and worldwide.

The Ministry of Foreign Affairs and Expatriates strongly condemns, in the harshest terms, the terrorist assaults carried out by Israeli settlers against Palestinian citizens and international solidarity activists during the national olive harvest season in the occupied West Bank.

The Ministry affirms that the actions of these armed settler militias, which take place under the protection and coordination of the Israeli occupation army, are part of a systematic and wide-ranging policy targeting our people. These attacks aim to prevent farmers from reaching their lands, assault them, burn their vehicles, and steal their olive crops, actions that constitute a continuation of the ongoing campaign of extermination, displacement, and obstruction of international momentum aimed at ending the Israeli occupation and the realization of the State of Palestine.

The Ministry also condemns the arrest by the occupation authorities of 32 foreign activists who were participating in a campaign to support Palestinian farmers during the olive harvest and to document settlers’ crimes. These atrocities represent a continued attempt to conceal the scale of these assaults and the violations of international law, as part of a comprehensive policy designed to erase all aspects of Palestinian life in the occupied Palestinian territory.

The Ministry of Foreign Affairs and Expatriates stresses that the actions of the Israeli occupation authorities and their various tools, including settler terrorism, aimed at displacing the Palestinian people from their land through terror, murder, uprooting of trees, and burning of crops, must not go unpunished. These practices not only constitute a flagrant violation of international law but also pose a grave threat to the values of justice and the very foundations of the international system, as well as to fundamental human rights and norms.

The Ministry calls upon all the international community to act immediately to put an end to these crimes, to protect Palestinian civilians, and to ensure their inalienable and legitimate right to live in security and dignity on their own land.

The State of Palestine condemns Israel’s attack and aggression against the Global Sumud Flotilla, in violation of international law and norms, including Convention on the Law of the Sea, other humanitarian principles, and the human rights of the participants on board.

The State of Palestine is gravely concerned about the safety of the over 470 participants and holds Israel responsible for their security and wellbeing of as they deliver humanitarian aid to a besieged, starved, and bombed population under genocide.

The State of Palestine recalls that the Global Sumud Flotilla is a peaceful and civilian led initiative aimed at breaking Israel’s inhumane and illegal blockade of the Gaza Strip and put an end to Israel’s starvation policy and genocide, in accordance with international law.

The State of Palestine reiterates that Israel, whose occupation of Palestine was declared illegal by the International Court of Justice, has no authority nor sovereignty over Palestine’s territorial waters, as it extends from the Gaza Strip, and over international waters.

The Global Sumud Flotilla has the right of free passage in international waters, and Israel must not interfere with its freedom of navigation, long recognised under international law. The State of Palestine also reaffirm that the Global Sumud Flotilla equally is permitted to navigate Palestine’s territorial waters to deliver humanitarian aid.

We commend the courageous participants and their determination to break Israel’s siege and end its genocide and call on the international community to extend them protection.
