Patience Jonathan will never go scot-free – EFCC

A group, the Human Rights Defenders and Advocacy Centre, HRDAC, has asked the Economic and Financial Crimes Commission (EFCC) to change its name and slogan from ‘Nobody is above the law’, since its could not probe and prosecute Patience Jonathan the wife of ex-President Goodluck Jonathan. Agbo during the protest lamented that “I have been to this same EFCC to bail several people over the issue of N500,000 passing through their accounts innocently. They were invited, they came voluntarily and you people held them. But we have somebody with our money, $15m which is N6bn, walking freely. On Ibrahim Babangida, Abdusalam Abubakar, Olusegun Obasanjo and Goodluck Jonathan. Agbo said ‘we have the issue of Badamasi Babangida; it is open knowledge that N12bn gulf money was missing under his regime, nothing is done; we are aware of Obasanjo and the $16bn power funds, you people are not investigating it; we are aware of the petition against Amaechi to the EFCC; we are aware that the APC did not get the funds for its election campaign from only Buhari’s account. We are aware that you are probing the Peoples Democratic Party, why are you not probing the APC?” he questioned The EFCC Deputy Director of Operations, Mr. Iliyasu Kwarbai, speaking with the protesters vowed that if its investigation uncovers evidence of corruption against the wife of former president Goodluck Jonathan, Patience, she would not be left off the hook and that ‘Nobody is above the law’, “Let me tell you, there is no sacred cow; anybody who is found wanting, who involves himself or herself in corrupt practices will not be spared. I have received your petition, it is here and what do we do? We go into investigation immediately. Now we have seen the name of Patience Jonathan; it is here. If she is found wanting, she will never go scot-free. So also any other person no matter how highly placed he is. “We must sanitize our country and provide a very good environment that people can come and invest in; an economy that is devoid of any economic and financial crime. So, we are happy to see you here; we have received it and we are going to go into action. I am going to inform my chairman that you were here and that we’ll commence investigation immediately.”

AGF justifies judges’ arrest, insists no one’s above the law

The Attorney General of the Federation (AGF) and Minister of Justice, Mr. Abubakar Malami (SAN), has justified the arrest of seven judges by the Department of State Services (DSS) at the weekend.

The minister spoke in Abuja yesterday at the inauguration of the Country Expert Review Committee for the second cycle of the review of the implementation of the United Nations Convention against Corruption (UNCAC).

Malami’s reaction came against the backdrop of mixed reactions that have trailed the arrest of the seven judges and the threat by the Nigeria Bar Association (NBA) to declare a state of emergency.

The judges — Justices John Inyang Okoro and Sylvester Nwali Ngwuta of the Supreme Court; Justice Muhammad Ladan Tsamiya of the Court of Appeal; Justice Kabiru Auta of the Kano High Court; Justice Mu’azu Pindiga of the Gombe High Court; Justice Ibrahim Auta, Chief Judge of the Federal High Court of Nigeria; and Justice Adeniyi Ademola — were arrested between Friday and Saturday by operatives of the DSS on allegations of corruption.

All seven judges were released on bail on Sunday night, owing to what the DSS said was the lack of co-operation of the National Judicial Council (NJC).

According to Malami, what happened in relation to the affected judges was a mere investigation of criminal allegations, contending that no one was immune to investigation under the Nigerian law.

He pointed out that once an allegation of criminality was raised, it was the duty of the relevant investigating agencies to carry out the investigation.

When asked by journalists to provide more insight into the judges’ arrest and release on bail two days later, he said nobody is exempted from being investigated, not even the president, vice-president, governors and their deputies who are covered by the immunity clause under Section 308 of the 1999 Constitution.

“The fundamental consideration is whether there is an allegation of the commission of a crime, whether there is the need for investigation, and whether the relevant provisions of the law and indeed, all circumstances, as provided in the Administration of Criminal Justice Act (ACJA) are put into consideration in our conduct as regards the fight against corruption.

“The bottom line is that we have a responsibility to fight corruption. Corruption is a crime and nobody, regardless of how highly placed is exempted as far as issues that border on crimes and criminalities are concerned.

“The limited exceptions as we know constitutionally are the exceptions of immunity. And to the best of my knowledge, those exceptions do not apply to investigation.

“For those that are conferred with the immunity, the right to investigate has not been taken away constitutionally.

“So I think the framework and the circumstances within which we are operating are clearly whether there exists the right to investigate or not, and whether the action borders on criminality.

“Once crimes and criminality are concerned, nobody is an exception. I think the undertone should be exclusively the consideration of the existence of a prima facie case; existence of reasonable grounds for suspicion of commission of a crime.

“And if there are, no member of the legislature, judiciary and executive can definitely be exempted from investigation. I think where we are now is the point of investigation and that is what is taking place,” he said.

The minister expressed confidence in the ability of members of the review committee to execute their responsibilities.

He said: “The extant review focusing on Chapter II and V of UNCAC, relating to preventive measures against corruption in public and private sectors and assets recovery, is both necessary and timely at this time in the annals of our country, when endemic cm systemic corruption has created a great disconnect between our nation’s wealth and the quality of life of ordinary citizens.”

Malami said that the objectives of UNCAC were in harmony with the conviction of the current federal government to curb corruption.

He said it was necessary for members of the committee to understand the important task of nation building which was being committed to their hands.

“Let me emphasise that the guiding principles of the review is non-adversarial, non-punitive and not aimed at ranking state parties.

“Nevertheless, members of the expert committee should understand that those selected, appointed or nominated by my office or your various agencies are chosen based on skills, expertise and commitment.

“It is therefore important to note that your performance in this assignment will be a step in the direction for us as a country and people to achieve the goals that we have set for ourselves – prevent corruption, recover, return and manage stolen assets,” he explained.

Members of the committee are drawn from 22 federal agencies including the Independent Corrupt Practices and Other Related Offences Commission (ICPC), the Economic and Financial Crimes Commission (EFCC), the Special Control Unit Against Money Laundering (SCUML), and the Technical Unit on Governance and Anti-corruption Reforms (TUGAR).

Malami, therefore, charged the committee to be transparent and efficient as much as possible in carrying out its mandate

Corruption: Buhari’s friends, associates won’t be spared – Osinbajo

To ensure that the Nigerian society was completely purged of corruption, Vice President Yemi Osinbajo has said that the anti-corruption war would be holistic and thorough to the extent that even the political associates and friends of President Muhammadu Buhari would not be spared.

Osinbajo who reiterated that the president had zero tolerance for corruption emphasized that he would never cover for his friends.

The Vice President spoke during a special interview session with some journalists at the presidential villa, Abuja on Tuesday.

He said: “The major drain on the country’s resources. No one would be spared in the fight against corruption because, even the close friends of the President know that they will not be spared; he will not cover for them. Fighting corruption is a priority”.

Osinbajo also revealed that 200,000 unemployed graduates had been selected to be engaged by the federal government under the N-power jobs Programme.

He said that this was in fulfillment of campaign promises of the present administration.

“We expect that before the end of the month, we will engage 200, 000,” out of the 500,000 unemployed graduates the Buhari administration plans to hire in the N-Power jobs programme.”

The current economic recession has been blamed on violation of the Fiscal Responsibility Act 2007, depletion of the Excess Crude Account (ECA) and continuous fall in price of crude oil at the international market.

The Minister of Finance, Kemi Adeosun, however, said the nation could emerge from the slump through borrowing, diversification, sale of national assets, lowering interest rates of loans, and cutting down cost of governance.

The Acting Chairman of the Fiscal Responsibility Commission (FRC), Victor Muruako, explained the cause of the economic decline, yesterday, during the opening session of a two-day stakeholders’ forum on ‘Building a strategic framework for reducing the cost of governance’, at the NAF Conference Centre, Abuja.

Muruako said: “It is worthy of note that successive governments have been misled by selfish counsel on cutting the cost of governance, while realities of very obvious cases of high overhead costs stare us in the face.”

“We have seen where budgets were prepared, not for necessity or solutions required in our system, but in such careless manner that agencies only fixed figures on paper, just to fulfill requirements. This is why we support zero-based budget, which is replacing the incremental one, where no critical effort is made to look at issues or specific items or requirements of the sectors.”

Adeosun, who was represented by the Director Special Duties, Mohammed Kari Dikwa, said through cost cutting measures introduced by the ministry, since inception of the President Muhammadu Buhari administration, budgeting and spending had changed.

Reeling statistics to buttress her position, she said the Federal Government had spent over N717.9 billion for capital expenditures, as at September 30, 2016, far more than what was spent by previous administration within the same time frame.

On initiatives for cutting cost through the Treasury Single Account (TSA), she said 17,000 commercial bank accounts owned by various Ministries, Departments and Agencies (MDAs) were closed down, just as the Federal Government saved N140 billion from Cost of Turnover (COT).

She added that N3.2 trillion belonging to the three tiers of government were mopped up into the TSA and disbursed accordingly, as at September 30, 2016.

The Anambra State Commissioner for Information, Communications and Strategy, Ogbuefi Tony Nnacheta, meanwhile has described stimulus package by the Governor Willie Obiano administration as successful in cushioning effects of the economic recession in the state.

At a briefing, yesterday, in Awka, Nnacheta added that government had set aside fund for the development of 500 hectares of land in all agrarian communities in the three senatorial zones of the state.

He urged citizens to form groups in order to benefit from the scheme. He gave the assurance that government would sustain its policy for economic growth in the state.
