Barangay 9 VAWC DESK Tulong at Proteksyon

𝐁𝐀𝐖𝐀𝐋 𝐁𝐀𝐒𝐓𝐎𝐒 𝐋𝐀𝐖

Ang Republic Act No. 11313, o mas kilala bilang Safe Spaces Act o Bawal Bastos Law, ay ipinasa upang palawakin ang proteksyon laban sa gender-based sexual harassment hindi lamang sa lugar ng trabaho o paaralan, kundi pati sa mga pampublikong lugar, online spaces, pampublikong transportasyon, at maging sa loob ng mga institusyon ng gobyerno.

Layunin ng batas na ito na 𝗽𝗮𝗿𝘂𝘀𝗮𝗵𝗮𝗻 ang mga kilos tulad ng: 𝗖𝗮𝘁𝗰𝗮𝗹𝗹𝗶𝗻𝗴; 𝗦𝘁𝗮𝗹𝗸𝗶𝗻𝗴; 𝗦𝗲𝗸𝘀𝘄𝗮𝗹 𝗼 𝗺𝗮𝗹𝗮𝘀𝘄𝗮𝗻𝗴 𝗸𝗼𝗺𝗲𝗻𝘁𝗼; 𝗺𝗴𝗮 𝗽𝗮𝗵𝗮𝘆𝗮𝗴 𝗻𝗮 𝗺𝗮𝗽𝗮𝗻𝗹𝗮𝗶𝘁 𝗼 𝗻𝗮𝗻𝗴-𝗼𝗼𝗯𝗷𝗲𝗰𝘁𝗶𝗳𝘆 𝗯𝗮𝘁𝗮𝘆 𝘀𝗮 𝗸𝗮𝘀𝗮𝗿𝗶𝗮𝗻.

Hindi na limitado ang saklaw ng harassment sa employer-employee relationship. Sakop din nito ang harassment na ginagawa ng mga kasamahan, estranghero, at mga taong nasa posisyon ng kapangyarihan, kabilang ang mga halal na opisyal.

Sa isang pagdinig ng Kamara, naging viral ang pahayag ng isang Kongresista kung saan nagbanggit siya ng halimbawa na tumutukoy sa isang aktres at naglarawan ng kanyang “𝗶𝗺𝗮𝗴𝗶𝗻𝗮𝘁𝗶𝗼𝗻” o pagnanasa. Ang naturang pahayag ay inalmahan ng ilang mambabatas at kalaunan ay ipinatanggal sa opisyal na record ng pagdinig dahil itinuturing na hindi angkop.

𝙈𝙖𝙮 𝙋𝙖𝙜𝙡𝙖𝙗𝙖𝙜 𝙗𝙖 𝙨𝙖 𝙎𝙖𝙛𝙚 𝙎𝙥𝙖𝙘𝙚𝙨 𝘼𝙘𝙩?

Maaari bang pumasok sa saklaw ng Safe Spaces Act ang ganitong uri ng pahayag?

Sa ilalim ng RA 11313, ipinagbabawal ang gender-based sexual harassment sa pampublikong espasyo, kabilang ang mga hindi kanais-nais na sekswal na komento o pahayag na nagdudulot ng takot, kahihiyan, o paglabag sa dignidad ng isang tao batay sa kanyang kasarian.

Bagama’t ang “imagination” ay hindi krimen sa sarili nito, nagkakaroon ng legal na usapin kapag ito ay:

• Binibigkas sa publiko
• May malinaw na sekswal na konotasyon
• Tumutukoy sa isang partikular na tao
• Nagdudulot ng panghihiya o pag-objectify

𝐁𝐀𝐖𝐀𝐋 𝐁𝐀𝐒𝐓𝐎𝐒 𝐋𝐀𝐖

Under R.A. 7610, it is the policy of the State to provide special protection to children from all forms of abu*se, neglect, crue*lty explo*itation and dis*crimination and other conditions, prejudicial their development; provide sanctions for their commission and carry out a program for prevention and deterrence of and crisis intervention in situations of child abu*se, explo*itation and dis*criminatio. The State shall intervene on behalf of the child when the parent, guardian, teacher or person having care or custody of the child fails or is unable to protect the child against abu*se, neglect, crue*lty explo*itation and dis*crimination or when such acts against the child are committed by the said parent, guardian, teacher or person having care and custody of the same.

🔎 𝐖𝐡𝐚𝐭 𝐝𝐨𝐞𝐬 𝐑𝐀 𝟕𝟔𝟏𝟎 𝐜𝐨𝐯𝐞𝐫?

RA 7610 protects children (below 18 years old) from:
(a) Child abu*se – physical, psychological, or se*xual harm
(b) Child exp*loita*tion – using children for profit, labor, or se*xual purposes
(c) Child dis*crimination – unfair treatment that har*ms a child’s development

𝗡𝗼𝘁𝗲: It goes beyond the home. The law applies in schools, workplaces, communities, and even online spaces. Even acts that are not physically violent but cause emotional harm can be punishable under the law.

𝐖𝐡𝐨 𝐦𝐚𝐲 𝐟𝐢𝐥𝐞 𝐚 𝐜𝐨𝐦𝐩𝐥𝐚𝐢𝐧𝐭?

Complaints on cases of unlawful acts committed against the children may be filed by the offended party; the parents or guardians; Relatives within 3rd degree of consanguinity; officer, social worker or representative of a licensed child-caring institution; officer or social worker from DSWD; Barangay Chairman; or at least 3 concerned responsible citizens where the violation occurred.

𝙋𝙚𝙣𝙖𝙡𝙩𝙮
RA 7610 imposes heavier penalties because the victim is a child. The law treats offenses against minors with greater severity than ordinary crimes. The penalty may range (depending on the acts committed) from Prisión mayor ((6 years and 1 day to 12 years) to reclusión perpetua (20 years and 1 day to 40 years)

𝐂𝐇𝐈𝐋𝐃 𝐀𝐁𝐔𝐒𝐄 𝐋𝐀𝐖 𝐨𝐫 𝐑.𝐀. 𝟕𝟔𝟏𝟎

𝗪𝗵𝗮𝘁 𝗮𝗿𝗲 𝘁𝗵𝗲 𝗮𝗰𝘁𝘀 𝗼𝗳 𝘃𝗶𝗼𝗹𝗲𝗻𝗰𝗲 𝘂𝗻𝗱𝗲𝗿 𝗥.𝗔. 𝗡𝗼. 𝟵𝟮𝟲𝟮?

Under this law, violence against women and their children may include:

🔹𝙋𝙝𝙮𝙨𝙞𝙘𝙖𝙡 𝙑𝙞𝙤𝙡𝙚𝙣𝙘𝙚– Any act causing bodily harm, such as hitting, slapping, or inflicting injury.
🔹 𝙋𝙨𝙮𝙘𝙝𝙤𝙡𝙤𝙜𝙞𝙘𝙖𝙡 𝙑𝙞𝙤𝙡𝙚𝙣𝙘𝙚 – Acts that cause emotional suffering, such as threats, intimidation, humiliation, stalking, or repeated verbal abuse.
🔹 𝙎𝙚_𝙭𝙪𝙖𝙡 𝙑𝙞𝙤𝙡𝙚𝙣𝙘𝙚 – Forcing a woman to engage in se_xual acts without her consent.
🔹𝙀𝙘𝙤𝙣𝙤𝙢𝙞𝙘 𝘼𝙗𝙪𝙨𝙚 – Controlling or withholding financial support, preventing a woman from working, or depriving her and her children of financial resources.

𝗜𝘀 𝗩𝗔𝗪𝗖 𝗰𝗼𝗺𝗺𝗶𝘁𝘁𝗲𝗱 𝗯𝘆 𝗺𝗲𝗻 𝗮𝗹𝗼𝗻𝗲?
Women can also be liable under the law. These are the le***an partners/girlfriends or former partners of the victim with whom she has or had a sexual or dating relationship.

𝗪𝗵𝗮𝘁 𝗰𝗮𝗻 𝘄𝗼𝗺𝗲𝗻 𝗮𝗻𝗱 𝗰𝗵𝗶𝗹𝗱𝗿𝗲𝗻 𝗱𝗼 𝘂𝗻𝗱𝗲𝗿 𝗥.𝗔. 𝟵𝟮𝟲𝟮?
Under the law, the offended party may file a criminal action, or apply for a Protection Order either as an independent action or as an incident in civil or criminal action and other remedies. The offended party may likewise avail the following protection orders:

a) Barangay Protection Order (BPO): Issued by the Punong Barangay; valid for 15 days.
b) Temporary Protection Order (TPO): Issued by a court; usually valid for 30 days but can be extended.
c) Permanent Protection Order (PPO): Issued by the court after a full trial; effective until revoked.

𝗪𝗵𝗼 𝗺𝗮𝘆 𝗳𝗶𝗹𝗲 𝗮 𝗰𝗼𝗺𝗽𝗹𝗮𝗶𝗻𝘁 𝘂𝗻𝗱𝗲𝗿 𝗥.𝗔. 𝟵𝟮𝟲𝟮?
Any citizen having personal knowledge of the circumstances involving the commission of the crime may file a complaint because violence against women and their children is considered a PUBLIC crime.
