COCOY ANDO MAKADAGAN PA OG KAPITAN SA 2028
The new law reads:
SEC. 5. Section 5 of Republic Act No. 12232 is hereby amended to read as follows:
"SEC. 5. Transitory Provision. – Considering the extension of their terms by two (2) years, incumbent elective barangay officials shall be regarded as having completed one (1) term in their respective positions. Incumbent officials serving their last term in the same position in accordance with Section 1 hereof shall be ineligible to run for the same position in the November 2028 Barangay and Sangguniang Kabataan Elections."
This excerpt amends Section 5 of Republic Act No. 11935 / RA 12232 (the law governing Barangay and Sangguniang Kabataan Elections) to clarify term limits and eligibility following term extensions.
Here is a breakdown of what this provision means in practice:
* Two-Year Extension Counts as Full Term: Because the terms of incumbent elective barangay officials were extended by two years, serving out this extended term legally counts as completing one (1) full term for the purpose of computing term limits.
* 3-Term Limit Application: Under Philippine law, barangay officials are restricted to serving a maximum of three (3) consecutive terms in the same position.
* Ineligibility for November 2028 Elections: Any incumbent official currently serving their third (last) consecutive term during this extended period is considered to have completed their full final term. Consequently, they are barred/ineligible from running for the same position in the upcoming November 2028 Barangay and Sangguniang Kabataan Elections (BSKE).
Essentially, the provision ensures that the two-year extension cannot be used as a loophole to bypass constitutional or statutory term limits. Officials on their final term must step down or seek a different elective position come November 2028.
Officials currently serving their second consecutive term are eligible to run for one more term in the upcoming election.
Here is how the law applies specifically to second-term incumbents:
* Completion of Second Term: The extended period counts as the official completion of their second (2nd) term.
* Eligibility to Run: Because Philippine law permits a maximum of three (3) consecutive terms for barangay officials, second-term incumbents are fully eligible to run for re-election in the same position for their third and final term.
* Remaining Term Cap: If re-elected in the upcoming election, that new term will serve as their third consecutive term, after which they will hit the mandatory 3-term limit and be barred from seeking a fourth consecutive term in the following election.
Unsa na? Mura namog naibtan og tunok mga second termer! Hehehe. Magamit pa ang akong mga tarps karong 2028.
