In the case of People v. Campuhan, G.R. No. 129433, March 30, 2000, the accused was originally convicted by the trial court of statutory r**e involving a minor, based on testimony that he was found in a compromising position with the child. The prosecution argued that the act already constituted consummated r**e, leading to the imposition of the most severe penalty under the law.
Upon review, the Supreme Court focused on whether the essential element of pe*******on was proven beyond reasonable doubt. The Court emphasized that consummated r**e requires clear proof of even the slightest pe*******on, and that mere external contact or suspicious positioning is not sufficient to meet this legal standard. In this case, the evidence failed to conclusively establish that pe*******on occurred.
As a result, the Court ruled that while the accused had begun committing the offense through overt acts, he was unable to complete all acts necessary for its consummation. The conviction was therefore modified from statutory r**e to attempted r**e, with a corresponding reduction in penalty, highlighting the strict evidentiary requirement for proving consummated r**e.
