Recto's transfer of Php. 60 billion PhilHealth funds to the national treasury is not plunder. It is technical malversation.🤔🤔🤔

FYI. Especially in a criminal case, an allegation is NOT evidence. An allegation & proving the allegation are worlds apart.🤔

FYI. In a criminal case, neither the prosecutor should be regarded as "hero" nor the defense counsel as "villain", vice versa. Both are officers of the court and agents for administration of justice.👍👍👍

Someone asked me this: "Yung retired gov't official na lawyer, ang bastos at laswa magsalita. Ka babaeng tao pa naman. Pwede ba yan mawalan ng lisensya bilang abogado?"
Me: "Oo naman, kahit nga walang complainant basta makita o mapansin yan ng Supreme Court. Pwede siya matulad ni Gadon."🤔🤔🤔

FYI. A simple explanation.
Especially in a criminal case, if the evidence presented by the State and Accused equal to 50-50, then acquittal results (Equipoise Doctrine). If the Accused can somewhat present weighty evidence exceeding 50%, all the more he should be acquitted.
Meanwhile, the State should prove the guilt of the accused beyond reasonable doubt in order to score a conviction. Why such a high requirement? It is based on the Constitution and in consideration of the massive resources and manpower of the State against a citizen being criminally charged.

FYI. On ICC matters:
Sudanese warlord RAHMAN's gross sentence was 416 years for the conviction of 27 counts of various offenses under crimes against humanity and war crimes but the final penalty was greatly reduced to 20 years only because of voluntary surrender and good behavior during initial detention.

FYI. This Sudanese warlord ABD AL RAHMAN is already convicted by the ICC on October 6, 2025 for crimes against humanity & war crimes. Tomorrow, December 9, 2025, will be his sentencing via FB and You Tube around 430pm Philippine time.
