LATEST ICC UPDATE!
The ICC Pre-Trial Chamber I on 7 January 2026 rejected a Defence request by former President Rodrigo Roa Duterte seeking an additional expert report on whether his cognitive condition reduces the risks cited under Article 58(1)(b) of the Rome Statute, including flight, witness interference, or the commission of further crimes.
The judges ruled that assessing these risks is a legal, not a medical, question for the Court, noting that a panel of court-appointed experts had already provided comprehensive medical and cognitive evaluations.
Finding no basis for further expert evidence, the Chamber denied the request and said the timing of any detention review hearing would be decided separately.
