NBI ARRESTS ONE FOR HUMAN TRAFFICKING

The National Bureau of Investigation (NBI) today announced the arrest of an individual by the operatives of NBI-Isabela District Office (NBI-ISDO) in an entrapment operation in Ilagan City for Human Trafficking.

NBI Officer-In-Charge (OIC) Director Eric B. Distor identified the arrested subject as NINA CARLOTA BAQUIRAN- MANSIBANG.

OIC Distor said that the operation stemmed from an intelligence report that Subject Nina is engaged in the illicit s*x trade, offering young women for s*xual services in exchange for a fee.

Acting on the said information, NBI-ISDO operatives conducted a surveillance operation against Subject Nina and were able to confirm the information. Two (2) members of the NBI-ISDO acted as poseur-customers and communicated with the subject thru her cellphone. The poseur-clients were able to request two (2) young ladies from the subject for s*xual services. As part of the agreement the poseur-client will pay the subject Php 2,000.00 each for the two (2) women and another Php 800.00 each for her own pocket money.

Thus, on August 11, 2021, NBI-ISDO operatives together with the poseur-client proceeded to Barangay Alibagu, Ilagan City and strategically positioned themselves in the vicinity. A few minutes later, Subject Nina arrived together with the 2 young ladies. One of the poseur-clients brought the ladies into their car and went back to Subject Nina to hand-over the entrapment money. As soon as the marked money was received by the subject, the rest of the operatives immediately approached the subject and placed her under arrest. The 2 young ladies rescued were turned-over to the Provincial Social Welfare and Development of Isabela.

Subject Nina was presented for inquest proceedings before the City Prosecutor of Ilagan City, Isabela for violation of R.A. 9208 as amended by R.A. 10364, otherwise known as ā€œThe Expanded Anti-Trafficking in Persons Actā€.

NBI ARRESTS 2, FILES CHARGES AGAINST INDIVIDUALS FOR SYNDICATED ESTAFA

Consistent with National Bureau of Investigation’s drive against all kinds of crimes, NBI-Isabela District Office (NBI-ISDO) have arrested two individuals and filed charges against several others for using DITO Telecom Corporation (DITO) in fraudulent acts.

NBI Officer-in-Charge (OIC) Director Eric B. Distor identified the main Subjects as FELIDO C. BAUTISTA, JULIET BAUTISTA, RYAN BAUTISTA, and FLORENCIO PADERNAL SR. Also included are the employees of B. BAUTISTA QUALITY CONSTRUCTION BUILDERS, INC. who claims to be connected with DITO.

Distor said that the case stemmed from information received by NBI-ISDO regarding an alleged telecommunication fraud syndicate victimizing landowners in the province of Isabela and some parts of Region 2. According to the informant, a certain ENGR. FELIDO ā€œBOBOTā€ C. BAUTISTA of B. BAUTISTA QUALITY CONSTRUCTION BUILDERS, INC. located in Santiago City, is claiming to be the lead contractor of DITO. The said scammer and fake civil engineer has defrauded individuals in Isabela province with his scheme.

The modus operandi of Subject BAUTISTA is to make representations as having the authority and capacity to identify and approve certain land areas in Region 2 for the construction of DITO towers. Allegedly, the respective areas will be leased by DITO on a lump sum offer of P3 Million to P3.5 Million for ten years subject to renewal.

Those who will qualify with the specifications of the desired land area are required to present and submit photocopies of documents needed such as land title, tax declaration, and valid ID. Thereafter, qualified landowners are being compelled to pay an amount ranging from P60,000 to P65,000 for relocation, back fill and vicinity map. However, since 2020, the promised construction of DITO towers did not materialize.

Certification from the Professional Regulation Commission (PRC) in Tuguegarao City, Cagayan revealed that the name FELIDO C. BAUTISTA does not appear in the database of all Engineering professions who are authorized to practice Engineering in the Philippines. On the other hand, verification with DITO revealed that FELIDO BAUTISTA is not an authorized agent, contractor, or sub-contractor of DITO.

With these, on July 6, 2021, poseur- landowner applicant inquired in B. Bautista’s office where RYAN BAUTISTA, son of FELIDO BAUTISTA, discussed the corresponding requirements.
On July 9, 2021, a follow-up transaction transpired in the same office where the poseur-landowner applicant was entertained by a staff identified as JULIET ā€œJHETā€ BAUTISTA, wife of FELIDO BAUTISTA, who discussed some processes and the corresponding payment.

After confirming the Subjects’ operation of fraud, Search Warrants were applied for and RTC Second Judicial Region, Santiago City issued the corresponding Search Warrants against FELIDO B. BAUTISTA and all employees of B. BAUTISTA QUALITY CONSTRUCTION BUILDERS, INC.

On July 30, 2021, operatives NBI-ISDO implemented the Search Warrants resulting in the seizure of various documents, DITO Tower Perspective View, Table of Organization (DITO Telecommunication Project), list of DITO Tower Cost, Special Power of Attorney/ Authorization as well as computers and other office equipment.

Operatives were about to arrest the Subjects when FELIDO BAUTISTA suddenly collapsed prompting the operatives to rush him to the hospital.

Due to the commotion in the area of operation, JULIET ā€œJHETā€ BAUTISTA and some employees managed to flee and elude arrest. RYAN BAUTISTA and FLORENCIO PADERNAL SR., however, were immediately taken into custody, apprised of their rights, and were brought to NBI-ISDO for booking procedures.

Subjects were presented for Inquest proceedings before the City Prosecutor's Office of Santiago City, Isabela for Syndicated Estafa and violation of R.A.544, as amended (Civil Engineering Law).

NBI ARRESTS 2 FOR ESTAFA, PERJURY AND FALSIFICATION OF DOCUMENTS

The National Bureau of Investigation (NBI) today announced the arrest of two (2) individuals by the NBI-National Capital Region (NBI-NCR) in Tanza, Cavite for Syndicated Estafa, Perjury and Falsification of Public Documents.

NBI Officer-In-Charge (OIC) Director Eric B. Distor identified the subjects as JULIETA V. SANTOS and RENATO FRANCISCO.

OIC Director Distor said that the operation stemmed from a complaint filed against Subjects Santos, Francisco and a certain Emerlita Santo Domingo, regarding an 8,632 sqm. parcel of land, which the complainant purchased in 2005 from Antonio Altiveros and Amelita Altiveros (previous owners) as evidenced by a notarized Deed of Absolute Sale.

Sometime in July 2015, complainant visited the property and was surprised to see a structure erected in her property.Complainant then lodged a complaint before the Barangay where the property is situated. The Barangay Chairman invited the offending party for a meeting. At the meeting, Subjects Santos and Francisco together with the current possessor of the property Teodora Cremat, all 3 of them claimed the property was sold to Cremat by Antonio and Amelita Altiveros as evidenced by a Deed of Absolute Sale dated October 3, 2005. However, a discrepancy was later discovered in the purported Deed of Absolute Sale. Antonio Altiveros (previous owner) died on March 24, 2005, seven (7) months prior to the Deed of Absolute Sale to Cremat where subjects Santos and Francisco signed as witnesses despite knowing that Antonio Altiveros is already dead. Complainant also verified the authenticity of the notary of the Deed and it was found that the subject Deed of Sale was not registered to the Notarial Registry. The complainant also found that the subjects unlawfully represented themselves as the owners of the 8,632 sq.m. property and even sold multiple small portions to various parties. To stop further illegal acts of sale and subsequent illegal structures on the property, complainant deployed security guards in May 2021. Complainant also discovered that the subjects falsified a Real Estate Mortgage (REM) Agreement by the subjects with the intention of foreclosing the property.

While conducting the investigation, it was discovered that Santos and Francisco were trying to sell 3 other parcels of land
owned by the complainant. NBI Agents, acting as poseur-buyers of the parcel of lots, under the guise of being interested buyers, were given xerox copies of titles of the 3 parcels of lots.

On July 8, 2021, NBI-NCR operatives conducted an entrapment operation in a resort in Tanza, Cavite. As soon as P1Million marked- money was handed over as downpayment for the property and subsequent signing of Acknowledgement Receipt, the undercover agents gave the pre-arranged signal that resulted in the immediate apprehension of the subjects.

Subjects JULIETA SANTOS and RENATO FRANCISCO were presented for inquest proceedings before the Provincial Prosecutor of the Province of Cavite in the City of Imus for violations of Article 315 (Estafa), Articles 171 and 172 (Falsification of Public Documents/Use Falsified Documents) and Article 183 (Perjury) all under the Revised Penal Code as amended.

NBI WELCOMES SENATE APPROVAL OF BILL AGAINST ONLINE SEXUAL EXPLOITATION OF CHILDREN.

Finding a strong ally from the passage of a Bill in the Senate against online s*xual exploitation, the National Bureau of Investigation (NBI) welcomed the Senate’s approval of Senate Bill 2209 otherwise known as the Special Protection Against Online Sexual Abuse and Exploitation of Children (OSAEC).

NBI OIC-Director Eric B. Distor said that with the passage SB 2209, the gov't has given the NBI and other law enforcement agencies more teeth to run after those who commit the dastardly crimes against our children. On May 27, 2021, the Senate unanimously approved on third and final reading the said bill, with 23-0-0 voting.

Senate Bill 2209 defines and penalizes OSAEC as a specific crime. The said bill advocates the provision of special protections to children from all forms of s*xual violence, abuse and exploitation, especially those committed with the use of information and communication technology (ICT).
Under the bill, production or creation of any form of child s*xual materials, participation in the production, or facilitating in the creation of such materials is punishable by law. Individuals or adults who engage in the grooming of children for the purpose of facilitating the commission of s*xual exploitation activity, as well as accessing, subscribing, or streaming any form of child s*xual abuse and exploitation materials will also be penalized.

The bill obliges internet service providers and social media intermediaries to block or remove the existence of child s*xual abuse or exploitation material or the streaming/live-streaming of a child s*xually abused or exploited, within twenty four (24) hours from receipt of notice containing sufficient information to identify the content and its source. They are also required to develop and adopt a set of systems and procedures for preventing, blocking, detecting, and reporting of OSAEC committed within their platforms, and to establish high privacy setting as default safety and privacy settings for children, and where necessary, adopt age-verification controls and protocols to restrict access to such materials.

"The NBI supports the approval of the bill as one of the Bureau’s Anti-Human Trafficking Division’s objectives is to combat online abuse and s*xual exploitation of children and strengthen their protection. With SB 2209, the NBI upholds its mandate to reinforce investigation, prosecution and adjudication of OSAEC cases", Distor emphasized.
