The Supreme Court of the Philippines, Second Division, has promulgated a pivotal Decision in People of the Philippines v. # # # and YYY (G.R. Evidence showed that the accused induced the minors to perform sexually explicit acts via live we**am for foreign viewers in exchange for payments sent through remittance services. Digital forensic findings, testimonial accounts, and financial records established the online exploitation scheme. The prosecution was strengthened through collaboration with U.S. Homeland Security Investigations, highlighting the importance of international law enforcement partnerships.
The Court held that maintaining minors for live-streamed sexual acts constitutes qualified trafficking under Republic Act No. 9208, even absent cross-border movement. It further affirmed violations of Republic Act No. 9775 and ruled that such exploitation within the home is punishable under Republic Act No. 7610.
The ruling significantly strengthens jurisprudence on Online Sexual Abuse and Exploitation of Children (OSAEC), clarifies the application of anti-trafficking and child protection laws to technology-facilitated abuse, and affirms the evidentiary value of digital and financial records in securing convictions. It likewise highlights the indispensable value of international cooperation, both formal and informal, including the effective use of Mutual Legal Assistance Treaty (MLAT) mechanisms in obtaining cross-border digital and financial evidence critical to prosecution. Likewise, the importance of specialized child-sensitive investigative tools such as Video In-Depth Interview (VIDI), which enables trauma-informed documentation of victim testimony while preserving evidentiary integrity in court proceedings.
Prosecutor Lo**ta Lomanta, who initiated and handled the prosecution of the case from its inception, states:
โThis is the validation of the victory we obtained in 2011 when we rescued the children and gave them hope. This affirmation by the Supreme Court confirms that justice, though long in coming, remains resolute. It stands as proof that even the most insidious crimes committed in the shadows of oneโs own home will be met with accountability.โ
