βοΈ 10 LEGAL FACTS YOU MUST KNOW BEFORE YOU POST ONLINE
Freedom online comes with responsibilities. Here's what the law says:
1οΈβ£ Freedom of speech is NOT absolute.
Under the 1987 Constitution, freedom of speech is protected β but it does not protect you from being held accountable for what you say. It is not a license to harm others.
2οΈβ£ Your post can be used as evidence in court.
Under the Rules on Electronic Evidence, screenshots, messages, and social media posts are valid and admissible evidence in courts.
3οΈβ£ One careless post can be LIBEL.
Under Article 355 of the Revised Penal Code, serious or disrespectful statements published online can be charged as Cyberlibel β punishable by imprisonment and fines.
4οΈβ£ False accusations can send you to jail.
Making false charges against someone may be prosecuted as Perjury, Slander, or even Malicious Prosecution.
5οΈβ£ Posting content of a child without parental consent is illegal.
Under the Child Protection Act and the Anti-Child Po*******hy Act, exploiting or posting a minor's images or information without parental consent is a criminal offense.
6οΈβ£ Deleting your post does NOT erase the evidence.
Screenshots, shared copies, and server records can still exist. Deleting what you posted is not a defense.
7οΈβ£ "It was just a joke" is not always a valid defense.
If your post causes harm, damage, or public ridicule, claiming it was a joke will not automatically absolve you of liability.
8οΈβ£ Online threats are criminal.
Threatening someone online falls under Anti-Bullying Act, RA 11313 (Safe Spaces Act), and may also be prosecuted as Grave Threats under the Revised Penal Code.
9οΈβ£ Adding "allegedly" does not protect you.
Labeling something as "alleged" does not make false statements safe from libel or defamation charges if they damage someone's reputation.
π Sharing private information without consent is a crime.
Under the Data Privacy Act of 2012, sharing someone's personal details, photos, or private communications without permission may be a violation of their privacy rights
π‘ REMEMBER:
The internet never forgets. A post today can return to affect you years from now. Think before you click β your words have power, and they have legal consequences too. β¨
