DIVORCE/KHULA PROCEDURE FOR OVERSEAS PAKISTANIS
Being a practicing lawyer dealing in the cases of Overseas Pakistanis, one question which is frequently asked by the Overseas Pakistanis is that how to get a Divorce / Khula without being present in pakistan. The answer to this question is very simple but little technical. And in this article, I will try to explain this procedure in simple words. There are two common type of divorce i.e. Talaq and Khula.
If you are a Pakistani citizen, living abroad, you can seek Khula from your husband from the court without being present in Pakistan and similarly, if a husband is living abroad, he can also divorce his wife without being present in Pakistan.
Procedure for Divorce
If you are living in a country outside from Pakistan, for example, you are living in the United Arab Emirate and your wife is residing Pakistan and your nikah was held in Pakistan, you can divorce your wife by sending a Power of Attorney to a close relative, friend or a person known to you. First, you need to execute a Divorce Deed, and make a Power of Attorney to authorize a person to proceed with the divorce proceedings on your behalf in Pakistan. You need to get the Divorce Deed and Power of Attorney signed by you in presence of two witness. Then you have to get the Divorce Deed attested by the Pakistan Embassy situated at Dubai. The officer in the Embassy will attest the Divorce deed and Power of attorney by putting the official stamp and signatures. Then, send the divorce deed and power of attorney to the person in Pakistan whom you have appointed as an attorney. Your attorney will submit the Divorce Deed along with the copies of the Power of Attorney to the Union Council where the Nikah was registered or where your wife has been residing for the time being. After the issuance of three notices to your wife, recoding of statement of your attorney on your behalf, and completion of ninety days, Divorce Certificate will be issued to you.
Procedure for divorce in case of Talaq e Tafweez or Delegated Divorce:
Though right to divorce is a right which has been given to the husband, but the husband has authority to delegate this right to his wife which is known as Talaq e Tafweez. In this case, the wife is given a right to divorce herself without filing a khula. If you are a woman who has been given right to divorce and you wish to use this right, and you are living outside pakistan, then you have to execute a Divorce Deed and appoint an attorney through Power of Attorney. You need to get the power of attorney and divorce deed attested by the High Commission Pakistan or the Embassy of Pakistan in your relevant country. Once both documents are attested, you have to send these documents through courier to your representative or attorney. Your attorney, after receiving the documents, will apply for issuance of divorce certificate along with the original divorce deed and the copies of the power of attorney at the union council. After issuance of three notices to your husband and completion of ninety days’ time period your will be issued divorce certificate.
Procedure of Khula
If you are a woman who is residing outside Pakistan, but your marriage was registered in pakistan then you can also apply for Khula without being present in pakistan. In this case, you must execute a Power of Attorney in favor of your attorney or representative to file for khula in Pakistan on your behalf and to submit the khula decree in Union Council for issuance of divorce certificate. You need to get this Power of Attorney attested from your nearest Pakistan Embassy or High Commission. After the attestation of power of attorney, you need to send this power of attorney to your representative in pakistan to file for khula decree. Your representative will appoint a lawyer who will file a khula case in court on your behalf and your attorney will be required to sign the khula petition and to record his or her statement before the Family Judge in Khula proceedings. After the issuance of khula decree, your attorney / representative will submit this khula decree in the Union Council along with the application of issuance of divorce certificate. The Union Council will issue three notices to your husband and after the completion of ninety days, you will be issued divorce certificate.
