"Commissioner Scott E. Thomas began his service at the Federal Election Commission (FEC) as a legal intern during the summer of 1975. The Commission had just opened its doors in the wake of the Watergate scandal and related congressional hearings. Upon graduating from law school in 1977, Mr. Thomas worked on the FEC's legal staff, eventually serving as an Assistant General Counsel in the Enforcement Division. In 1983, he became Executive Assistant to then Commissioner Tom Harris, a Democrat and one of the original FEC commissioners.

"In 1986, with Commissioner Harris retiring, President Ronald Reagan appointed Mr. Thomas to the remainder a six-year term. He was reappointed in 1991 by President George Herbert Walker Bush, and reappointed again by President William Jefferson Clinton in 1997.

"Commissioner Thomas served as FEC Chairman in 1987, 1993, and 1999. He served as Vice Chairman and Finance Committee Chair in 1992 and 1998. He also has served on the Regulations Committee, the Litigation Committee, and the Commission Operations Review Committee. He has focused over the years on improving the enforcement process through the Enforcement Priority System and adequate staffing, restricting the use of 'soft money' through the Commission's allocation regulations, and streamlining Commission audit, reports analysis, and disclosure procedures.

"Commissioner Thomas hails from Wyoming where he graduated from Lander Valley High School in 1970. He received a degree in political science from Stanford University in 1974, and graduated from Georgetown University Law Center in 1977."

STATEMENT OF REASONS OF CHAIRMAN MATTHEW S. PETERSEN AND COMMISSIONERS CAROLINE C. HUNTER AND LEE E. GOODMAN

The Complaint in this matter allegeid that the Foundation for a Secure and Prosperous America and Susan Neithamer in her official capacity as treasurer ("FSPA") violated the Federal Election Campaign Act of 1971, as amended (the "Act") because it did not file reports with the Commission disclosing its "expenditures" for six videos.' The videos criticized Paul's position on then-ongoing negotiations between the United States and Iran while Senator Rand Paul was a candidate for the Republican Party's 2016 presidential nomination. Four of the videos were posted solely to YouTube and two videos were both posted to YouTube and also aired as television advertisements. The Commission unanimously agreed with the Office of the General Counsel that FSPA did not violate the Act because these communications did not expressly advocate Paul's defeat and, therefore, were not independent expenditures. Accordingly, FSPA was not required to file independent expenditure reports. Because these videos did not constitute expenditures, the Commission also unanimously agreed that FSPA's payments to produce them did not trigger a requirement for it to register with the Commission as a political committee and to file periodic disclosure reports. However, our colleagues opposed the Office of General Counsel's recommendation— which we approved— that FSPA's four videos posted solely to YouTube were exempt from regulation under the well-established Internet exemption. Our colleagues voted as a bloc to reject the proposed factual and legal analysis because it referenced the Internet exemption. We are issuing this separate statement to set forth our reasons for dismissing the matter, including the application of the Internet exemption.

Former FEC Chairman Scott Thomas Joins Campaign Legal Center Board
DATE JANUARY 8, 2015
The Campaign Legal Center is pleased to announce that Scott Thomas, former Chairman of the Federal Election Commission (FEC), has joined the organization’s Board of Directors. Mr. Thomas is currently co-leader of the Public Policy and Political Law Practice at the law firm Dickstein Shapiro.

First appointed to the FEC by President Reagan in 1986, Mr. Thomas was reappointed by President Bush in 1991 and by President Clinton in 1997 and served until 2006. While at the FEC, Mr. Thomas was involved with efforts to require disclosure of party soft money and to strengthen the Commission’s enforcement process.

“Scott brings to our board a wealth of experience and expertise from his decades in the field of campaign finance, including twenty years as an FEC Commissioner where it was my great pleasure to serve with him in the 1990s,” said Trevor Potter, former Chairman of the Federal Election Commission and president of the Campaign Legal Center. “He will be a tremendous asset to our board and we look forward to working with him for many years to come.”

“I look forward to serving on the Board,” said Mr. Thomas. “The Campaign Legal Center has provided a valuable service to the public over the years by promoting transparency in government and laws that encourage broad participation in our democratic process.”

Mr. Thomas served for nine years as an attorney in various capacities at the FEC before his appointment as a Commissioner. He is a member of the District of Columbia bar and admitted to practice before the U.S. Supreme Court, the U.S. Court of Appeals for the Ninth Circuit, and the U.S. District Court for the District of Columbia. He has served on the American Bar Association (ABA) Standing Committee on Election Law as well as the Elections Committee of the ABA’s Section on Administrative Law and Regulatory Practice. A native of Wyoming, Mr. Thomas graduated from Stanford University and received his J.D. from the Georgetown University Law Center.

A former Federal Election Commission (“FEC”) Chairman, Scott Thomas focuses his political law practice on campaign finance, ethics, lobbying, and elections law. His extensive background in the area of political law is a valuable resource in providing guidance and assurance to clients who need to interact with government officials or want to engage politically. His practice group also has significant experience in setting up nonprofit organizations and helping them with governance and tax law requirements as they engage in political or lobbying activities.

With more than 30 years of experience in this field, Scott assesses current compliance issues and suggests best practices to ensure adherence to the rules. Given the ever-changing law and its interpretations by regulatory bodies, he provides up-to-date advice that enables businesses, associations, PACs, and others to work successfully with government representatives at the federal, state, or local level.

Scott served as an FEC Commissioner from 1986 to 2006. He was appointed to the FEC for three consecutive terms by Presidents Reagan, Bush, and Clinton. He served as chairman in 1987, 1993, 1999, and 2005.

From 1983 to 1986, Scott served as executive assistant to former FEC Commissioner Tom Harris, and from 1980 to 1983 as an FEC assistant general counsel for enforcement. He began his legal career as a staff attorney with the FEC in 1977.

He also has general experience in areas of election law other than campaign finance, stemming from the FEC’s Office of Election Administration and his work with election officials here and abroad. Additionally, his involvement with the Council on Governmental Ethics Laws and various governmental bodies over the years has provided him with a breadth of knowledge on ethics and lobbying rules.

According to Chambers USA, “Sources report that ‘his experience is incredible,’ and add: ‘As a past FEC chairman he wrote the regulations, so he understands them. He is very knowledgeable and his breadth of expertise is unmatched.’”

Outside the Firm

Scott still plays basketball with his law school buddies on Saturday mornings, and is a Washington Wizards fan to the end. He and his wife Elena love to travel to the far reaches of the globe.
