Attorney General Ken Paxton Challenges Dallas Over State Fair’s Fi****ms Ban
State law permits licensed gun owners to carry fi****ms in places owned or leased by governmental entities unless otherwise restricted by state law.
After the State Fair of Texas announced a ban on fi****ms this year, Attorney General Ken Paxton is warning the City of Dallas about what he describes as an “unlawful infringement on Second Amendment rights.”
Last week, fair organizers introduced a new set of safety regulations, including a ban on all fi****ms, even for those with a license to carry. Previously, licensed individuals were permitted to carry fi****ms at the fair. However, following a shooting incident last year at the fair’s food court, in which three people were injured, the policy was revised. The shooter, Cameron Turner, did not possess a license and reportedly snuck into the park.
Earlier this week, a group of 70 state lawmakers wrote a letter urging the State Fair to reconsider the policy. In response, fair officials stated that the ban was “a measure to create a more family-friendly atmosphere” and argued that, as a private organization, they have the right to set their own firearm policies.
However, Attorney General Ken Paxton is notifying the City of Dallas that the Fair’s argument is flawed.
According to a release from his office, the City of Dallas entered into a 25-year lease with the State Fair of Texas in 2002, authorizing the nonprofit organization to manage the governmental function of Fair Park during the twenty-four days of the annual event.
State law permits licensed gun owners to carry fi****ms in places owned or leased by governmental entities unless otherwise restricted by state law.
“Texas law clearly states that license to carry holders may not be prevented from carrying a firearm on property owned or leased by the government unless otherwise prohibited by state statute,” said Paxton. “The State Fair of Texas’s recent policy infringing on LTC holders’ Second Amendment rights is unlawful. Dallas has fifteen days to address the issue, or I will see them in court.”
Chris McNutt, President of Texas Gun Rights, praised Paxton’s action.
“We are grateful for the Attorney General’s swift action and strong support for the Second Amendment. It’s crucial that lawful gun owners are not stripped of their right to self-defense, especially at a public event like the Texas State Fair,” said McNutt.
The fair is scheduled to run from Friday, September 27 through Sunday, October 20.

Justice Department Announces Rule Ending Private Firearm Sales At Gun Shows, Tightening Licensing Requirements
The proposed rule will prohibit private individuals from renting tables at gun shows and expand licensing and background check requirements.

A spokesperson for Sen. Cornyn issued a statement describing the rule as unconstitutional and saying both Cornyn and Sen. Thom Tillis (R-NC) plan to introduce a resolution of joint disapproval. Cornyn’s office added the Biden administration is acting lawlessly with the proposal and that the vast majority of it has nothing to do with the SCA authored by Cornyn. Cornyn's office emphasized their belief that the rule does not enable or empower the DOJ to propose this rule and provided a letter submitted to the ATF regarding how the proposal violates the congressional intent of the statute.
U.S. Attorney General Merrick Garland announced the publication of a new rule in the federal register, which after it becomes effective in 30 days will expand the circumstances wherein individuals need to obtain Federal Firearm Licenses (FFL) and perform background checks to sell guns.
The rule adds definitions to certain statutory terms enacted by Congress in the Safer Communities Act, legislation championed by Texas Sen. John Cornyn (R-Texas) that became law in 2022 and was billed as a solution to prevent mass shootings.
Under the proposed rule, private individuals will still be allowed to buy or sell a firearm without being a licensed dealer as long as they only make “occasional sales, exchanges, or purchases of fi****ms for the enhancement of a personal collection or for a hobby, or who sells all or part of his personal collection of fi****ms.”
However, if a person represents to a prospective buyer that they can obtain more fi****ms for them to choose from, spends more than their reported taxable income on fi****ms, repeatedly sells fi****ms after owning them less than 30 days, creates records to track the profit and loss from firearm sales, rents a table at a gun show, and any combination additional elements, that individual is required to obtain an FFL and conduct background checks on the sales.
Prohibiting private sellers from renting tables at gun shows has been a priority for the Biden administration.
“Under this regulation, it will not matter if guns are sold on the internet, at a gun show, or at a brick-and-mortar store: if you sell guns predominantly to earn a profit, you must be licensed, and you must conduct background checks,” Garland said in a statement announcing the rule. “This regulation is a historic step in the Justice Department’s fight against gun violence. It will save lives.”
Texas Gun Sense, which advocates for tighter restrictions on fi****ms, issued a statement applauding the new rule, writing, “Requiring background checks on gun sales is a common sense measure supported by the majority of Americans. It's especially important in states like Texas, where background checks are not required for private sales, including those at gun shows and online.”
Gun Owners of America (GOA) slammed the proposed rule in a series of posts on social media, writing that its broad application violates the Second Amendment, and promised legal action.
“[The] ATF can't even promise that we won't need a federal fi****ms license, a background check, & gun registration records to sell just one gun to a family member. This rule is an infringement on the Second Amendment, & undermines private firearm sales, which are legal in 30 plus states,” GOA posted.
According to the DOJ, the new rule will become effective in 30 days. During a public comment period on creating the proposed rule last year, some 338,000 responses were submitted by the public.
