The Maryland Department of Health’s Developmental Disabilities Administration (DDA) has responded to CMS’ Request for Additional Information (RAI) on its proposed Community Pathways Waiver Amendment. DDA anticipates a decision from CMS within 90 days. Implementation of proposed changes remains on hold until federal approval is received. This includes the following:

1. Self-Directed Services (SDS) budget methodology and rates
The current SDS budget methodology and wage rates remain in place, and the proposed new methodology and rates will not take effect until CMS approves the waiver amendment.

2. 60/40 Family as Staff
The current Family as Staff requirements remain in place, and the proposed 60/40 limitation will not take effect until CMS approves the waiver amendment.

3. Community Provider rate changes
Current Community Provider rates remain in place, and the 2% rate reduction for the Community Provider-Managed model will not go into effect until CMS approves the waiver amendment.

Today, DDA received a CMS request for additional information on its Community Pathways Waiver Amendment, submitted on July 1. We are working closely with CMS to provide the requested information and address outstanding questions. Changes proposed in the waiver amendment will not go into effect until approved by CMS. In the meantime, DDA will continue its planning so that we are prepared to move forward once the federal review is complete. We will provide updates along the way.
