Well, it happened again. Actually the same day it had the new date listed, it was again rescheduled. It very much seems like they are waiting for something, perhaps the en banc decision in Koons?

It's really hard to read the tea leaves here, but at least it isn't a denial!

IMPORTANT NOTICE TO MARYLAND FI****MS OWNERS

The Maryland State Police has issued guidance regarding the ATF's recent decision affecting the making and transfer of short barrel ri**es and sh****ns regulated under the National Fi****ms Act of 1934 (NFA).

The Maryland State Police is correct that Maryland requirements remain in effect.

We strongly encourage Maryland fi****ms owners to consult with a qualified fi****ms attorney before acquiring or taking possession of any item regulated by the NFA.

Surprisingly, just a day after Novotny v. Moore was rescheduled to the Oct 9 conference, it has again been rescheduled. We will be watching for a new date. While we can only speculate as to the reason for the case being rescheduled again so quickly, it is likely that at least one Justice wanted to put off consideration until at least the following conference. The case is still alive, and no denial yet is also positive.

G***k case update: Judge Richard D. Bennett heard arguments on the plaintiffs’ motions in Bathras and Duffy cases (consolidated) for a preliminary injunction and denied the motions from the bench, stating the court would issue a written opinion this next week. The case is far from over.

Today the consolidated reply brief in support of our motion for a preliminary injunction in Duffy v. Moore was filed. This is our challenge to the G***k ban.

This is our argument to the court on why, despite the State's argument, we should be granted a Preliminary Injunction.

Our case has been consolidated with Bathras Sr v. Moore. Much like in our SB1 litigation, we will have the full opportunity to argue our own case, but for efficiency, some portions will be done concurrently. This consolidation was expected.
