PUBLIC NOTICE: FI***RM LAW UPDATE — NEBRASKA

Rock County Sheriff’s Office will not be enforcing or making any arrests based solely on anyone (who is not prohibited from owning a fi***rm) for possession, purchase or sale of any suppresser, short barrel r***e or short barrel sh***un.

This is information for you to make your own decision on whether to own these items or not.

Recent changes to federal ATF guidance regarding suppressors, short-barreled r***es (SBRs), and short-barreled sh***uns (SBSs) have raised questions about whether these items can now be made or possessed without federal paperwork.

Nebraska residents should be aware that changes in federal enforcement do not automatically change Nebraska state law. Nebraska Revised Statute § 28-1203 specifically addresses possession and transportation of short-barreled r***es and short-barreled sh***uns and includes criminal penalties and exceptions.

Before making, purchasing, or possessing one of these items, verify how current federal guidance and Nebraska law apply to your situation. Do not assume that the removal of a federal paperwork requirement means the fi***rm is automatically legal under state law.

For the applicable statutes, visit the Nebraska Legislature and consult a qualified fi***rms attorney if you have questions about your specific circumstances.

So, what does the DOJ’s letter actually mean?
On September 24, the Solicitor General notified the Senate Judiciary Committee that the Department of Justice has determined not to appeal the ruling.

The notice was sent under 28 U.S.C. § 530D, which requires the DOJ to notify Congress about certain decisions involving the constitutionality of federal laws, including when DOJ decides not to appeal a ruling affecting their constitutionality. In other words, this isn’t just a press statement, the DOJ’s decision not to appeal has been formally placed on the congressional record.

What does this mean for you? You still complete a Form 4473, you still pass a background check, and your state laws still apply.

SBRs and SBSs are a separate issue. Because of existing GCA requirements, they still require a Form 4 for now. However, We’re working to change that.

There is no membership is required. If your transaction comes through Silencer Shop, you are covered by the court’s injunction.

As the lead plaintiff in the lawsuit, Silencer Shop Foundation will continue to keep you informed with the most accurate and up-to-date information as this moves forward.
